Shortly before 9 pm on November 10, 2019, a 2018 CanAm Commander 4 seater ATV, driven by Charity Lara, 31, of Livingston, was south-bound on Rhett’s Run Road. The ATV was occupied by five people (Lara and four passengers, three in seats and one sitting on a lap in the back). The ATV left the unpaved road to the left, struck a culvert, went airborne, landed, and began to roll. During the rollover, the lap passenger, Alyssa Fleming, 21, of Livingston, was ejected. Preliminarily, it is believed that the ATV rolled over Fleming causing massive internal injuries. Allegiance Ambulance Service was dispatched to the scene along with the Livingston Volunteer Fire Department Heavy Rescue Unit, Deputies Garrett Childers and Corporal Austin McCracken with the Polk County Sheriff’s Office and Troopers Ashlee White and John Allen with the Texas Highway Patrol. EMS personnel immediately began CPR on Fleming. After lengthy attempts by EMS personnel using CPR and no response, Fleming was pronounced deceased at the scene. Justice of the Peace, Darrell Longino performed an inquest at the scene. A first-call car from Cochran Funeral Home transported Fleming from the scene. Lara and the other three passengers were all transported by ambulance to CHI Livingston Memorial Hospital with undisclosed injuries. The ATV was recovered by Fawbush Wrecker Service and will be stored in Goodrich. This accident remains under investigation by the Texas Highway Patrol.
