On July 17, 2017, deputies with Precinct 4 Constable Mark Herman’s Office responded to the 15600 block of Mason Road in reference to a disturbance. Upon arrival the complainant advised a Hispanic male suspect in a black pickup truck rammed into his vehicle several times after a verbal argument took place causing the complainant to wreck his vehicle. The suspect then pointed a handgun at the complainant and his passengers and threatened to kill them before fleeing the scene.

Constable Deputies obtained the suspect’s license plate number and registered address. The suspect was transported back to the scene and was positively identified by the complaint and witnesses.

“The suspect was identified as Daniel Diaz who was arrested and booked into the Harris County Jail, charged with Deadly Conduct in County Court 013. His bond was set at $1,000.00.”

    What is so different what Brandon Ogden did on July 6 to what this jerk did? Why was Ogden only charged with misdemeanor and this guy is probably deservedly charged with a felony? How can pointing a gun at somebody and shooting be a misdemeanor? Diaz pointed his gun but didn’t fire, Ogden did. And why was Ogden’s misdemeanor Deadly Conduct charge dropped? The main difference here is Diaz was stupid in Harris County and Ogden was in Montgomery County. Who does Branden Ogden know?

    That sort of conduct in other jurisdictions would have resulted in at least two FELONY charges, not the misdemeanor version of Deadly Conduct. It should have included at least one charge of Aggravated Assault with a Deadly Weapon (the vehicle) and one of Failure to Stop and Render Aid (aka leaving scene of accident).
