CONTROLLED BURN EARNS PROPERTY A TICKET

Thursday morning Porter Fire Department responded to a controlled burn at  20476 Louis Lane at Duester in Porter Heights. The owner of the property and several workers were clearing the land of an abandon home and debris so he could move a mobile home in. Firefighters were met with several complications. The fire had spread to the house which was approximately halfway through the destruction process. The house was heavily involved when they arrived but next to the house was an oak tree approximately eighty feet tal which was burning bottom to top. The top section was extremely weak. Witht e threat of it falling on the house Porter Assistant Fire Chief Carter Johnson pulled the crews out of the house and had a crew cut the tree down.

Fires like this tie up fire equipment for an hour to several hours. If another fire is dispatched units from other departments or stations must respond.

Assistant Fire Marshal Scott Burlin cited the land owner under Local Government Code 352.082 which makes it illegal to burn household trash if you have less than five acres of land or are in a subdivision. Burlin told the land owner it was illegal to burn anything more than leaves or small tree limbs. The Class C citation was written in Precinct 4 Judge James Metts Court.

Fernando Lopez Cardenas, age 28 of the 2000 block of Barnsley could be fined up to $250.

TEXAS LAW AS IT APPLIES TO MONTGOMERY COUNTY

§ 352.082. OUTDOOR BURNING OF HOUSEHOLD REFUSE IN CERTAIN RESIDENTIAL AREAS. (a) This section applies only to the unincorporated area of a county: (1) that is adjacent to a county with a population of 3.3 million or more; and (2) in which a planned community is located that has 20,000 or more acres of land, that was originally established under the Urban Growth and New Community Development Act of 1970 (42 U.S.C. Section 4501 et seq.), and that is subject to restrictive covenants containing ad valorem or annual variable budget based assessments on real property. (b) In this section, "neighborhood" and "refuse" have the meanings assigned by Section 343.002, Health and Safety Code. (c) A person commits an offense if the person intentionally or knowingly burns household refuse outdoors on a lot that is: (1) located in a neighborhood; or (2) smaller than five acres. (d) An offense under this section is a Class C misdemeanor. On conviction of an offense under this section, the court shall require the defendant, in addition to any fine, to perform community service as provided by Section 16(e), Article 42.12, Code of Criminal Procedure. § 352.082. Quema al aire libre de residuos domésticos en determinadas
ZONAS RESIDENCIALES. (a) El presente artículo se aplica únicamente a la
área no incorporada del condado:
(1) que se encuentra junto a un condado con una población de
3.3 millones o más, y
(2) en el que una comunidad planificada se encuentra que ha
20.000 o más acres de tierra, que fue establecido originalmente bajo
el crecimiento urbano y la Nueva Ley de Desarrollo Comunitario de 1970 (42
USC Sección 4501 y ss.), y que está sujeto a restricción
convenios que contienen ad valorem o el presupuesto anual variable basada
las cuotas de los bienes inmuebles.
(b) En esta sección, "barrio" y "rechazar" tienen el
significados asignados por la Sección 343.002, Código de Salud y Seguridad.
(c) Una persona comete un delito si la persona intencionalmente
oa sabiendas quema al aire libre residuos domésticos en un terreno que es:
(1), ubicado en un barrio, o
(2) menores de cinco hectáreas.
(d) Una ofensa bajo esta sección es un delito menor de clase C.
En la convicción de una ofensa bajo esta sección, el tribunal
exigir a la parte, además de la multa, para llevar a cabo
servicio a la comunidad conforme a lo dispuesto por el artículo 16 (e), el artículo 42.12 del Código
de Procedimiento Penal.
