DEPUTY COMES CLOSE TO HAVING TO USE DEADLY FORCE-UPDATE

Just before 1 AM Sunday Montgomery County Dispatchers received a call for a panic alarm at the Stripes Gas Station on Valley Ranch and FM 1314. With units responding a female Montgomery County Precinct 4 Deputy was just down the street and arrived on the scene. Not seeing anything suspicious on the inside she entered the store and was told by the employee that the reason the button was pushed was the two Hispanic males that were in the store. He told the deputy that the two came in and bought an 18-pack of beer and paid for it. The employee gave the one male change for the $20 that he presented. It was then the male asked where the remainder of his change was and tried to say he gave the employee a $100-dollar bill. When the employee stated it was only a 20 the 20-year-old male threatened the employee with bodily harm. The males were still in the store and the deputy ordered them to the ground. The 20-year-old refused and became belligerent with her. He kept reaching into his pockets after several orders to keep his hands in view. Again, she ordered him to the floor as he advanced on her with firearm drawn. She deployed her taser which took him to the floor. It was then his older and much larger brother advanced on the deputy swatting at her and attempting to get to her gun. She backed up and was able, with a gun in one hand and taser in another to key up the radio calling for help. Other units were already en route when the assist the officer was dispatched. Houston Police, Montgomery County Sheriff’s Office, DPS, Precinct 4 and other units responded as she kept the large male at gunpoint. As units arrived, they got the younger male detained but the larger male also tried reaching into his pants and deputies had to slowly pull his hands out from under him to restrain him. Both males were taken to separate patrol cars where they commenced kicking the interior of the vehicle and spitting on the officers. Lionel Guillen was charged with terroristic threat for threatening the store employee and resisting arrest, both misdemeanors. Jose Guillen was charged with interfering with public duties, also a misdemeanor. Jose Alberto Guillen, 27, who was the one attempting to get the officers weapon, has been arrested several times before. In June of 2013, he was arrested by Humble Police for possession of marijuana and given 9 months’ probation in Harris County. Then in January of 2015, he was again arrested for possession of marijuana in Houston and was sentenced to 10-days in jail. Then in January 2015, Houston Police arrested him again for possession of marijuana. Again, he was sentenced to 10-days in the Harris County Jail. Then in July of 2017 Montgomery County Precinct, 4 Constables arrested him for driving while license invalid and a Montgomery County Judge sentenced him to 2-days in jail. His brother, Lionel Guillen, age 21, and the brother of Jose has had his share of brushes with the law also. In July of 2017, he was charged with possession of brass knuckles. In February of 2018, he was arrested for purchase and furnishing alcohol to a minor. In May 2018 he was charged with resisting arrest and I June of 2018 was arrested for driving while intoxicated with a blood-alcohol level of at least .15.
