Just after 9 p.m. last night Montgomery County Precinct 4 Constables Office and DPs attempted a traffic stop on a vehicle that was northbound on US 59 approaching Fostoria Road. They activated their emergency equipment at which time the vehicle pulled to the right shoulder near the Fostoria overpass as if they were going to stop.
However that wasn’t the case. The passenger started throwing bags of drugs out the window. They then were stopped almost 300 yards further down the road.
As DPS ordered the the two occupants to show their hands before he approached the vehicle. The driver Mozel Cleveland III, 34 of Cleveland exited the vehicle. Montgomery County Precinct 4 Deputy Constable Juan Chapa ordered the passenger to exit the vehicle, the passenger, instead of complying pulled his hands back into the vehicle and onto his lap. Fearing for his life Deputy Chapa drew his weapon and once again ordered the passenger to show his hands and exit the vehicle.
The passenger, with signs of loose marijuana on his clothes exited the vehicle. Inside more loose marijuana was found. Deputies then went back and recovered a one gallon baggie full of marijuana. Officers suspect that when they started the traffic stop the passenger tried to through the marijuana out of the window loose. However after it started blowing back in on him he threw the entire bag out.
Mozel Cleveland III, 34 of 1222 Grove Road in Cleveland is being held in the Montgomery County Jail on charges of evading arrest and detention with a vehicle and has a $1,500 bond. He is also being held with a $1,500 bond on possession of marijuana more than 4 ounces but less than 5 pounds and with tampering with evidence.
His passenger, Cedric Wayne Gambrell, 36 of 2011 Ross in Cleveland is also being held in the Montgomery County Jail on tampering with evidence and possession of marijuana more than 4 ounces and less than or equal to 5 pounds.
Their vehicle was impounded.
