Grand Jury Approves County Attorney’s Capital Murder Petition Against Juvenile

photo of samFollowing the tragic shooting of Shamsuddin “Sam” Sadruddin at the Z.P. Mart Shell on SH 105 on Monday, March 24, 2014, the Montgomery County Sheriff’s Office identified a 13-year-old male as one of the two actors believed to have committed the offense. Authorities believe Mr. Sadruddin was intentionally killed and that both actors were engaged in an armed robbery at the time, making the offense a capital murder. This morning, May 6th, prosecutor Marc Brumberger with the Montgomery County Attorney’s Office presented a petition for capital murder against the juvenile to the Grand Jury. County Attorney J D Lambright states, “The Grand Jury approved the petition, which now authorizes us to seek a determinate sentence against this juvenile.”

According to Lambright, “Because the juvenile is below the age of 14, he is not eligible to be certified as an adult to stand trial in criminal court. By obtaining Grand Jury approval to pursue a determinate sentence, he is now eligible for a sentence of up to 40 years in the Juvenile Court.” Lambright further explained that, if adjudicated, “the child will begin serving his time in the Texas Juvenile Justice Department, which used to be called the Texas Youth Commission. Then, at some point prior to his 19th birthday, the Juvenile Court will determine whether he should be discharged, released onto parole, or made to continue serving out the remainder of his sentence in the Texas Department of Criminal Justice.”

A trial date for the 13 year-old has not been set. The District Attorney’s Office is continuing their investigation regarding the 19 year-old.

    When someone starts murdering at 13, he should be locked up for the rest of his life–not to rot in prison, but to work and partially pay his victims. This would stop some of this. A person five years old knows that you don’t kill others. That 14-year-old age thing needs to be changed first thing in the morning. Change the age to 5 or 6. Use common sense.
