A Porter man was convicted for the offense of a felon in possession of body armor and sentenced to 50 years in the Texas Department of Criminal Justice. A jury in the 359th District Court convicted Michael Shane Dunn, 37, for having body armor in his home.
Prosecutors Jo Ann Linzer and Darla Faulkner presented evidence that, while investigating a stolen truck, Detective Swilling with the Montgomery County Sheriff’s office located military grade body armor in Dunn’s home. Swilling, along with Deputy Rippley found the body armor in a hole in the wall of Dunn’s bedroom. After Dunn showed Detective Swilling his Texas Department of Criminal Justice Offender card that verified he was indeed a convicted felon, Dunn was placed under arrest. From the Montgomery County jail, Dunn made phone calls to his wife admitting that he attempted to hide the body armor from the officers on the scene. Testimony from Sgt. John Nichols provided the jury information about the seriousness of possessing body armor designed to protect Dunn from high power rifle fire such as an AK-47. Linzer argued this type of body armor is a higher grade than that used by our officers who protect and serve our community. This body armor is used to go into battle and that there is no good reason for a felon to have it in his possession.
After being found guilty, Dunn chose to go to the jury for punishment. Linzer presented evidence that Dunn had been to prison on two separate occasions and is a confirmed member of the Aryan Brotherhood of Texas, in addition to testimony that Dunn has been violent while in the custody of the Montgomery County jail awaiting trial. After deliberating for more than four hours the jury sentenced Dunn to 50 years in the Texas Department of Criminal Justice. District Attorney Brett Ligon stated, “This is exactly the kind of man that prisons were built for.”
