On October 20, 2011 at approximately 4:30pm, Sgt. D. Park with Montgomery County Pct. 5 Constable Department responded to a disturbance at FM 1488 and Abney Ln. Upon arrival he met with a male subject that advised his home, which had been destroyed in the recent wildfire, had been robbed of the copper. The complainant told Sgt. Park that he was able to locate the suspects at a local scrap yard, which then turned in to a car chase between the home owner and the suspects. The suspect driving the vehicle had pulled to the side of the road, where all three suspects exited the vehicle and fled on foot. When Sgt. Park arrived, he recognized the vehicle and knew of a nearby house where the suspects might run to. Upon arrival at the residence, Sgt. Park met a male subject identified as Brian Smith, 27. Brian stated that he was riding with James “ Scooter” Counts, and that he had just got back from the scrap yard. While searching the house, a female identified as Terry Sirmans was located hiding in a bedroom. Terry stated that she was also at the scrap yard with Brian and Scooter. While detaining Terry, Lt. J. Buchanan noticed a clear plastic baggy of Methamphetamine on her dresser. Brian and Terry were both taken back to the complainant’s location, and a positive ID was made on both subjects. Scooter Counts, was not located at the time, but charges have been filed and his vehicle was seized. All three subjects face charges for Theft of Copper, a State Jail Felony. Terry Sirmans also faces a charge for possession of a controlled substance, also a State Jail Felony.
