STATE Law Enforcement GROUP calls for Judge Case to resign

Today, the state’s largest law enforcement organization, called on Judge Kelly Case to resign immediately from the 9th District Court of Montgomery County. CLEAT, the Combined Law Enforcement Associations of Texas is the state affiliate of the Montgomery County Law Enforcement Association.

“Judges who side with criminals or even worse with child predators are not fit to sit on the bench,” stated Charley Wilkison, CLEAT’s Executive Director. “That is not justice and he is not fit to be a judge,” he stated.

Earlier this week, Judge Kelly Case allowed a dangerous, sexual predator to be freed from an indictment after declaring that the entire online solicitation of a minor statute violated the First Amendment.

In the case before the court, Daniel Paquette of Kingwood, arranged to meet a 14 year old girl he contacted through Craigslist. Mr. Paquette offered the 14 year old money for sex and then traveled to Porter to meet at an apartment in Montgomery County. When he arrived at the location, he was taken into custody by the Internet Crimes Against Children task force. When arrested, they found the agreed upon money in his possession and a condom. Yet, Judge Case dismissed the case.

The law cited by Judge Case essentially prohibits a person from using the internet or other electronic communications in an effort to arrange to meet with a minor child for sex. This statute forms the basis of a large portion of the work that the county’s Internet Crimes Against Children task force has been so effectively using to target child predators in the Montgomery County area.

Despite the task force’s many successes in catching predators, Judge Case has time again and again ruled in favor of criminals, some who have been repeat offenders.

CLEAT is the largest law enforcement association in Texas representing over 20,000 law enforcement officers.
