WOODLANDS MAN WITH 4 PRIOR DWI’S CHARGED AFTER LEAVING THE SCENE OF A FATAL LIVINGSTON CRASH

Trooper Nick Hatton, with the Texas Highway Patrol, arrested the man who is allegedly responsible for the death of 18-year-old Cole Overstreet, of Livingston. On September 26, Trooper Hatton arrested Roy Grant Wagner, 40, of The Woodlands. Wagner got a ride to the Polk County Sheriff’s Office and turned himself in, Hatton was summoned and made the arrest. Wagner was northbound on FM-350 South on the evening of September 24, 2021, when he crossed the center line near Kate Lowe Road and slammed head-on into Overstreet’s south-bound pickup. The accident took the life of Overstreet. Wagner fled the scene. During the ongoing investigation, Wagner was found to be in possession of marijuana and a military-style rifle and was charged for both.

Wagner has been charged with: Failure to stop and render aid resulting in death, unlawful carrying of a weapon, and possession of marijuana. This incident remains under investigation by the Texas Highway Patrol.

Awful Night as LHS Student Killed in 2 Vehicle Accident, LIVINGSTON, September 25, 2021 – At approximately 11 pm on September 24, 2021, a head-on accident occurred on FM-350 South at Kate Lowe Road that claimed the life of an 18-year-old student of Livingston High School. The student, Cole Overstreet, of Livingston, was southbound on FM-350 South in his navy blue 2005 Dodge pickup when the driver of a black 2016 Dodge pickup (that was northbound) crossed the center line and slammed (head-on) into Overstreet’s vehicle. The impact spun Overstreet’s vehicle around facing north as this pickup came to rest in a ditch on the southbound side. The other pickup came to rest in a ditch on the northbound side. According to witnesses, the driver of the other pickup fled the scene. Allegiance Ambulance Service was dispatched to the scene along with the Livingston Volunteer Fire Department Heavy Rescue Unit, Deputies from the Polk County Sheriff’s Office, and Trooper Nick Hatton with the Texas Highway Patrol. Sadly, Cole Overstreet was killed on impact. All traffic on FM-350 South was blocked during investigation and cleanup. Justice of the Peace, Robert “Dooley” Johnson performed an inquest at the scene. Overstreet was transported from the scene by a first-call car from Cochran Funeral Home. A jar containing marijuana was found in the other pickup (the 2016 Dodge Ram).  An investigation by the Texas Highway Patrol into the accident is underway that includes evidence and witnesses of who the driver of the other pickup was. Both vehicles were recovered by LakeView Wrecker and will be stored in Livingston. We will update this story as to who the other driver was if and when we receive that information.
