AUTO PEDESTRIAN FATAL CRASH

Early this evening Dean McIntyre, 50, of Splendora and his wife Janet were traveling north on the feeder road of US 59 just south of FM 1485 in their van when they ran out of gas. They walked to a nearby gas station and got fuel but when they returned to their vehicle realized the battery had died while the emergency flashers were on.

Juan Rocha was northbound on US 59 just south of FM 1485 when he blew out a tire. He attempted to change the tire but realized he did not have a lug wrench. Broken down in close proximity to McIntyre he found that McIntyre had a lug wrench. The plan was for McIntyre to assist Rocha in changing the tire and Rocha who had battery cables was going to assist McIntyre after the tire was changed.

As McIntyre walked across the entrance ramp Of US 59, 44-year-old Tina Witt of Splendora was entering the freeway northbound, driving a 2011 Mercury. With the rain and mist she did not see McIntyre and struck him.

McIntyre was pronounced dead on the scene just after 6 p.m. by Montgomery County Precinct 4 Justice of the Peace James Metts. Metts ordered Eickenhorst Funeral Directors to transport the body to the Montgomery County Forensic Center for autopsy.

DPS is continuing the investigation. No charges have been filed at this time.
