Don Collins, who stands accused of sexually molesting and then setting fire to 8-year-old Robbie Middleton in 1998 will stand trial as an adult. Judge Kathleen Hamilton, of the 359th District Court rendered her decision Thursday morning after days of agonizing testimony, photos and a video deposition given by the victim before he succumbed to cancer in 2011 as a result of the horrific crime.
Because the accused was a juvenile at the time of the crime. County Attorney J.D. Lambright was responsible for prosecuting the case. His office chose to pursue having Collins certified to stand trial as an adult. The case will now be referred to another district court and will be handled by the office of Montgomery County District Attorney Brett Ligon.
Collins learned his fate as he stood flanked by court-appointed defense attorney E. Tay Bond.
