Garret Nee was found guilty this afternoon after a 90-minute deliberation by the jury. Nee was stopped on Fathers Day 2016 by Patton Village Officer Bumgartner. He then fled down SH 242 with the officer chasing him. When they got to FM 1485 Nee made it through the intersection but Bumgartner was t-boned by a Suburban with a family returning from a Fathers Day dinner. Their 11-year-old son perished in the crash. Bumgartner who was trapped was freed and transported to the hospital where he was pronounced deceased. Nee who returned to the scene after seeing the crash in his mirror was taken into custody. The trial which started Monday ended today. He is guilty of 2-counts of evading causing death and 4-counts of evading and causing serious bodily injury. The also found the vehicle to be considered a deadly weapon. That finding makes him ineligible for parole until 50% of his time is done. The punishment phase starts Monday in Judge Grants Court and is expected to last 3 days. Nee showed no emotion as the verdict was read.
