COUNTY ATTORNEY EXPLAINS THE HORSE SEIZURE PROCESS

Montgomery County Attorney J.D. Lambright remains on the scene of Calico Dairy tonight as his assistants finish drawing up the seizure order for just over 180 horses. Many, but not all the horses are in severe health, many skin and bones and no hoof care in a long time. Lambright’s Office is working on the civil side of the case which includes the seizure. Meanwhile Montgomery County District Attorney, who has been on the scene the past few days will handle any criminal charges.  Late Wednesday afternoon a Gradall was called out from the Montgomery County Precinct 1 Commissioners Office to look at several areas they believe horse may have been buried.

Lambright acknowledged as did Ligon that this was no easy task. The logistics is massive. Until the Houston SPCA stepped up to the plate this week, the dilemma was going to be how to handle almost 200 horses and where to put them. The horses would need to remain together until after a seizure hearing which could not take place by law prior to 10 days after the seizure. During that time the horses would have to have medical care, feed,and medication. This would rest on the shoulders of the taxpayers of Montgomery County.Even though they were more concerned with the horses the dairy cattle could have come into play. If they had to be seized they would require not only feed but to be milked at least twice a day. However, at this time the dairy herd appeared in good health and were not being included in the seizure.
The County was unable to locate a vet that was willing to take a task like this on. With that many head of horses any vet would have to be away from his practice until the case was disposed of. In addition it would require them to spend time in court to testify on the case which could last a long time.

Even if Montgomery County Justice of the Peace Wayne Mack ordered the animals be turned over to the county at a seizure hearing the county would have to continue the task of caring for them until they could be placed.

Many people across the United States were down on officials for not acting faster, however they had to work on the investigation, talk to many witnesses and start putting a logistics plan into place. This week the SPCA agreed to assist. They responded this morning to put a game plan in effect. Even to decide how they would handle so many horses, veterinarians also came with them and looked at some of the horses. Many they say may still not make it. Even to transport 200 horses in a confined trailer, in summer heat and in Houston traffic could affect their health.

As the County Attorney worked out the details of the seizure order for Judge Mack to sign sometime tonight, the District Attorney’s Office Investigators, armed with a search warrant confiscated files, computers and anything else that could assist them in preparing a case against the owner of Calico Dairy.

Once the seizure order is signed tonight , deputies from Montgomery County Precinct 4, Precinct 5 and the Montgomery County Sheriff’s Office will stand guard over the herd which occupies 40 acres on League Line Road. Amazingly, the entire area, League Line Road, the subdivisions on both side and the back of the 40 acre farm are in the City Limits of Conroe. Calico Dairy, however was not included when the area was annexed.
