D&M Burglar Arrested

On Saturday, September 10, the Cleveland Police Department was called to 1100 East Houston (D&M Diner) in regards to a burglary of the business.

Officers found that an unknown male suspect made entry into the business by breaking a window.

The suspect then proceeded to take a small amount of money from the business and exited business the through a rear door. Officers processed the crime scene for evidence and reviewed surveillance footage. A still image was obtained of the suspect and disseminated to area law enforcement.

On Sunday, September 11, Liberty County Precinct 6 Constable Sergeant Larry Allen contacted the Cleveland Police Department advising he had a possible lead on identifying the burglar.

On Monday, September 12 the suspect arrived at the Cleveland Police Department and met with Captain Scott Felts and Detective John Shaver. The suspect was identified as Nicolas Allen Dewitt, 24, of Rye, Texas. A subsequent interview found that Dewitt was the same person observed on the video footage of the burglary. Dewitt advised he was informed that Sergeant Larry Allen had been looking for him the previous day. Dewitt admitted to the burglary and advised he was remorseful for his actions.

Nicolas Allen Dewitt was arrested and charged with “Burglary of a Business” which is a State Jail Felony.
