Many think the officers need to do more. How much more can you do. We have so many officers in Montgomery County trained in handling DWI cases. We have one of the top DWI prosecutors in the nation to the point the Department of Transportation is looking at the DWI programs here. But still we have the divers who think it is ok to drink and drive. Early this morning we has three innocent people killed by a drunk driver this brings the number of innocent people this year up to eight. Below is just how much our law enforcement has been doing. Since Thursday when the Fourth of July no refusal started there have been forty DWI arrests. This is after the repeated warnings, the ads, the signs. Maybe all the establishments serving alcohol need to bear the cost of a flashing billboard sign in the entrance to the parking lot or business entrance “THIS IS A NO REFUSAL WEEKEND” or some type of message. People seem as they want to drink no mater the cost, add one dollar to the drink and let that pay the sign expense for the owner. Tru it may not do any good for the corner store selling beer, or the liquor stores or even individuals having parties, but it is a start.

If you are stopped in some states and drugs are found, you lose your ride. Should be the same here and if you are convicted of DWI, you should lose your vehicle along with your licence. This 2nd and 3rd and so on is crazy. The bars around need to held responsible for for the actions of their employees. Its time to start pulling a licence or two. But TABC needs to take change and start doing something about it and show they mean business. Sometimes action does speak louder that words. Pull a few permits, and see how long it takes for word to get around.
The lady from Friday mornings accident wasn’t working at the bar, she was just drinking. A pervious comment on FB from the bartender who SERVED her said she was falling down drunk when she left. She has since removed her comment. The Bar/Bartender are just as responsible as she is. Yes, she could have called a cab, but they saw the condition she was in and let her leave. Just like the case in Sunday mornings accident. This is why TABC will be going to those bars. If someone leaves a bar and gets into an accident the bar/bartender are held accountable as well! And the excuse of being to busy….THAT IS WHY YOU HAVE A TAB! These are checked. I had a group of 10 people that got cut off because are tab as a whole was to much, so yes this is looked at.
All I have to say is-personal responsibility!! It’s not the bar, bartender or waitresses fault if someone chooses to drink and drive-it’s a choice made by that person alone!! I realize that the idea of personal responsibility is a very foreign one these days, and one this country very much needs to get back to!!
And yes, the DWI arrests are a huge cash cow for the state and the county…and Montgomery county is about the ONLY county in the state with no diversion program, or deferred adjudication…sometimes people make one mistake and learn their lesson, those are the ones who shouldn’t have the rest of their lives ruined by that one mistake…NONE of us can really claim that we never ever drove a bit impaired, especially when in college or college age…the repeat offenders or ones who kill or hurt anyone need to be punished harder, I buy that…and also, why these people who live in Harris or another county choose to come get drunk in Montgomery county just amazes me!!
It’s not that hard people. Me and my husband went out for a friends engagment party and had a little too much to drink. WE CALLED TWO PEOPLE TO COME PICK US UP along with our vehicle. Yes, it was midnight and yes it was an inconvenience, but everyone was safe. Priceless.

My DAD was killed, not only by a DRUNK DRIVER, BUT ALSO A WRONG WAY DRIVER!! My daughter, my twin sister’s daughters and my older sister’s kids will never know there grandpa, never even got the chance to see us grow up, graduate, marry. My twin sister was put in a coma for 9 months, and all ribs broken, both legs broken. My older sister pen’s and screws in her leg, and internal injuries and my own injuries. WE WERE ONLY 9 YRS OLD WHEN WE LOST OUR DAD, DUE TO A DRUNK DRIVER & WRONG WAY DRIVER!!!! The man took off and never got charged in our DAD’s death. I’m glad these Drunk Drivers will be charged and too bad they don’t get the Death Sentence in this country.. Because, Prison is a nothing, the have it made in there. They still get to see there family, and get to touch and hold them. I work in the prison system and I see the Drunk Drivers who kill all the time in the prison and I don’t feel sorry for them. The made the decision to drink and drive. Most Drunk Drivers in the State of Texas Don’t even make it to Prison, most get a slap on the wrist and get to have their freedom again, to kill again. So, I don’t feel sorry for the Drunk Drivers. The pain for the families is a life long pain, a whole in our hearts, our families lives will never be the same because of a Drunk Driver & Wrong way driver. Were would our lives be today, had a Drunk Driver not taken the life of our DAD! He was an Awesome FATHER & DAD too. Who know’s, would it be different, I’m sure… But, we will never know. BECAUSE OF THE SELFISH ACT OF 1 PERSON WHO MADE THE CHOICE TO DRINK AND DRIVE. Why couldn’t THEY call family or friends.. where were yall when they needed you to call on. PRAYERS TO THE FAMILY AND FRIENDS WHO LOST A LOVED ONE IN THESE SENSELESS ACTS.. I KNOW HOW YOU FEEL, I UNDERSTAND WHERE YOU ARE COMING FROM AND IT’S A LONG ROAD AND IT NEVER GET EASY… PRAYERS… I CAN SAY THAT, I LIVE IT EVERYDAY, AND EVERY DAY KNOWING I’LL NEVER SEE MY DAD AGAIN AND HE WILL NEVER GET TO MEET HIS GRANDKIDS, NEVER GOT TO SEE US GROW UP. Other people can’t say they know or understand, but for those who are in my shoe’s I feel for you, because, more needs to be done. Slap’s on the wrist isn’t working, look at all the repeat people who get the chance to get it right, to Kill again. We need tougher LAWS on Drinking a Driving.
On August 11, 1996, at 11:00am, I was laying on my back with a 1/2 full bottle of beer. Drunk out of my mind. I made the decision that alcohol had taken control of my life and I was no longer in charge. I quit drinking. My TRUE friends encouraged me, even those who continued to drink, they never offered me any alcohol after I told them I was now clean and sober. They respected me for my decision and I appreciate their continued encouragement. I took a cruise trip, the same cruise I was on when I made the decision to quit, to test my metal. I found myself alone in my room deciding whether or not to go up to the club areas. I assured myself that I wouldn’t drink. When I arrived at the door, I looked in and said to myself “who are you kidding?” I turned around and went back to my cabin to reflect. I have been clean and sober due to one thing. I dont’ want to change the “sobriety date and time because I would have to start all over.” Amazing but true story. I hope everyone is safe over the 4th and don’t ever drink and drive. A friend will come pick you up. For real. And you have many friends to call, just make the call. You never know – it could save your or a loved ones lives, or some innocent person.
The views of American society is too lax when it comes to drinking, which leads to drinking while driving. It’s sooo ridiculous to think that the amount of drinking can be controlled. Just because a patron orders and buys two drinks, it doesn’t mean that’s all they drank. What about the stupid notion that underage teens are allowed in a bar with a wristband and that is supposed to completely ensure that they won’t be drinking from their 21YO buddy’s glass??!! What about parents that have parties for their kids with booze….that’s the dumbest of them all. These parents think they are doing their kids a lesson, meanwhile they are proving booze to other kids whose parents have no idea. This will only get worse and continue escalating in America.
Law enforcement is doing the best they can-businesses need to get on board, adding a DWI tax to all liquor sales would be a good thing! It is a sad fact that we have to wait until a life is lost, or a person is terribly injured, to file a suit in a civil court to have any sort of restitution for the loss of that individual or their injuries, and it will never be enough. We have to have changes in the state laws!!! They are too lenient, too many are getting off early on their sentences, getting their TDL’s back, and going right back to DWI!!!! Come on Texas Legislature!!! 8 DWIs and you’re letting a person out?? And how long did it take before they even received jail/prison time?? THIS is where we are failing!!!! The wimpy Texas State laws and the spineless Judges!! We have a real group of alcoholic lawyers and Judges where I live-see them out all the time!! I have a friend who works at HPD and they said that TABC is underfunded in Texas and spread thin…at the most they only have time to come to our city every 2 weeks and only cover the convenience store liquor sales! No coveraqge of all the liquor establishments doling out massive quantities to the SHSU students, who then leave and hit the roads drunk as hell!! Then there are the idiots who drink all day watching futbol at home and then go out drunk as hell at 6am in the morning to wreck peoples lives!! Convicted for 2 DWIs and still out on the road!!! No jail time-still have their TDL-slap on the wrist!! Thanks a lot to the drunken, impaired Judges who keep letting this go on in Huntsville and Walker county!!!
I have an idea. I’ll buy a bus, find a sober driver and make a regular route.
We’ll just load them up and take them to jail. No, wait, that won’t work. We’ll take them home for a nominal fee.
I can just see them now all in a tipsy line waiting for the bus to take them home. Heck, we could serve drinks to the first class passengers…
It’s a tough call. Most of us have “been there, done that” with your’s truly at the front of the line.
We all must be more responsible for ourselves.
I never thought I would see the day in Texas where I would get out of the car, sign the speeding ticket, retrieve the beer from where I just set it on the hood of the car, get back in and drive home. Probably not many of you remember those days so I must say that we’ve come a long way but we are not out of the woods yet.
I still enjoy a libation on occasion but most of them are enjoyed at home where I just might injure myself stumbling to bed and not someone else.

If there are so many people in the bar that the waitresses cannot keep up with how much they have served someone then that’s a problem. A good waitress will now when a patron has hit their limit. A good doorman will know when someone is a bit “tight” yes it’s hard to tell sometimes but if there is a question of which it is then they should be turned away or have a cab called.
Like you said bar owners can be held civilly responsible. Civil cases might be the answer to that part of the equation and it might raise a few eyebrows, making owners a little more cautious, but unless and until the drunks and those who give them access to a vehicle are held at the same level of responsibility for the drunks DUI’s, DWI’s and wrecks/ injuries/fatalities, then drunks will continue to kill people.
@JB.. I am one of the pots calling the kettle black. A couple of times when I was 17 – 19 I did just as you and many others, but then I had children and quit partying. I’m in my 50’s now, don’t party outside or at home..I just don’t drink anymore. I did become the DD, I was called every name in the book for taking someone home or hiding their keys. I threatened to call the Police when someone was trying to leave too tipsy to drive and I have called the Police on my own family members, (who arrived drunk), for leaving my home still too drunk to drive.
The Police can sit outside a bar waiting for drunk drivers but they cannot pull them over unless they have a reason to. If they swerve out of their lain or they hit something …something that would normally be an offense or give reason for the officer to think they are impaired. It doesn’t have anything to do with the Police trying to help the bars stay in business by not nabbing the drunks as soon as they leave. It is also hard to prove who served the drunk..if there is only one bartender or one server and the patron was drinking alone then it is obvious, other wise it’s their word against the server/barkeep & it could be the case that friends were ordering drinks and then giving it to the drunk. It bites but that’s just the way it is.
I am not sure about them going into a bar to check the patrons sobriety but I think it would be the same reason they cannot come into your home without a legal reason or warrant…don’t quote me on that because I am not sure.

A Bartender or waitress that is working his/ her Tail off may not be able to keep track. What do we do about the guy that arrives at a bar drunk but handles and hides his booze well and the bartender serves them one or two drinks? Or the Bar has multiple bars at one location, who is responsible then. Diffucult situation. I do believe in shared responsiblity but at what extent and how much? Maybe a better idea is not criminal responsibility but civil and each case decided on a case by case basis. Kinda how it is done now. I am sure the young lady and her victims from this weekend will have a good civil case against the resturant and bar she was working at and later got drunk at before leaving drunk, geting on the freeway going the wrong way and killing those two young people…… If you can prove the establishment should have known how drunk someone is before they got behind the wheel you can punish them in civil Court. I believe that is where it should remain.

Certainly this is due to law enforcement, education, and safer cars (airbags and such). And certainly we always want to strive to do better.
When I see all the repeat offenders on Scotts list, I am shocked. Apparently people do not learn the lesson and the first penalty should be harsher.
My question is what can we, regular citizens do to help? Can we become bac administrator certified and man dwi checkpoints? what can we do?
HONESTLY I have been behind the wheel many times when I sure as heck should not have been.
Usually you are at a club with your friends and you are all so high on booze or the shots everyone is passing around that you think you are good an able to drive. I have had friends try and take my keys but they don’t try to hard because they themselves are drunk as well and just listen as I claim to be sober enough to drive. Ive woken up many times wondering how I got home and why my car was parked sideways or whatever. I know many many friends that have done the same and continue to. I’m not going to sit and play innocent and bash others I think my story is similar to many others on here that just don’t want to admit it.
I rarely ever drink anymore and have always offered to be a ride home to all my friends when they are going home. They usually don’t call..like I said when its you in their shoes..high on booze, having a great time, looking to follow others to the next party or someones house to party. You really have no good judgment at all. That is what alcohol does alters any and all the good sense you had.
After reading these last two crashes I cringe at the thought I could have been that driver. How could I have lived with myself? I am a very responsible, educated, and successful person. Point fingers and bash all you want but after a few drinks all good judgement goes right out the door. You are invincible, its party time!! Or so that’s what your drunk brain is telling you. Who cares about the hell of a hangover tomorrow, you are having a blast…right??
I can bet many of the comments are from people that have stood right in my shoes and prob continue to. Go into any of the bars from Houston to Conroe on a Friday or Saturday night about 1 am and you will see lots of the same.
People of all ages, races, and backgrounds are doing it. Wake up its not just the younger ones, its not just the poor and some are very well educated. To sit and judge is avoiding the problem all together. I think the bars need to be held accountable at some level. I know I have stumbled past a doorman or two in my days, loud, drunk and clearly in no condition to be driving. Only to hear, “have a good night” in the background as I walk by.
I have also noticed in the last few weeks the area from spring to Conroe late at night is covered in flashing lights from cops with people pulled over doing sobriety tests on drivers. And as listed on this site, they are clearly out there trying to really impact DWIs in this area and others.
What is the solution? should You have your keys taken and held if you chose to even start drinking at a bar? Ever tried to take the keys from a drunk? Designated Drivers? Ever had a car full of drunks and tried to drive them home as they are shouting, singing, crying, wanting to go to the next party and yelling at you for taking them home instead? Being a DD is also a hard job and putting yourself at risk as a crazy drunk is distracting your driving.

again go into any of the many many bars after midnight on weekends and you will see the bars making their money getting people drunk..then sending them on their way, in their cars. Why can’t cops sit outside of all the bars? Why cant cops walk into the bars and inspect the patrons? Oh wait then they would lose business right? I mean their business is worth way more than the lives that were just lost right?
Not trying to ruin anyone’s business or fun but I think just one life is worth that and I know at the time I was drinking a lot, I would have thought twice about it if cops were sitting outside waiting for me.

On April 30, 2000 in Red Rock, Texas, my niece and her husband were killed by a drunk drive two times over the legal limit. He eventually received 28 years.
Melanie and Reggie left behind 3 small boys that my sister in law and her husband had to raise.
If they can legislate the requirement of forced health insurance under the guise of making Americans responsible or else be “fined” then they can darn well force drunk drivers/DUI’s and those that allow them access to vehicles to be responsible for their actions.
Bartenders and waitresses know that it takes 1 hour for ounce of alcohol metabolize…they also are taught the laws governing the sell and serving of alcohol. If they serve a patron till he/she is drunk then they should be held just as responsible as as the driver/killer. They should have the same fine and the same jail/prison sentence. Zero tolerance should mean Z-E-R-O tolerance!
Good job Montgomery County, however the fact that 1/2 of them are repeat offenders is disappointing to say the least. Until they come up with a way to make drunk drivers stay off the roads it will not stop, although Mr. Ligon is making huge strides. I wonder how much money is generated by all the above.
wreckers, fines, lawyers, doctors, hospitals, mortuaries, bails bondman, courts, jails etc, etc plus the cost to the tax payer for court appointed attorneys, housing the offenders in jails … HUM – This is big CASH COW! I am not talking prohibition. I am talking making anyone-establishment serving alcohol be held responsible (of course fines and jail also)OH BRAIN FART – Do like the strips clubs now! extra $5 per patron – Heck extra $10 per patron that drinks – 5 per patron and 5 from establishment. Carry this out to all alcohol – extra on each beer and liquor. This money for victims! hum – what better way to have another avenue to generate MORE CASH – REVENUE, also for dead victims relatives! Wow – I want to head up this fund – will do for a .1% fee… sure someone hop on this – This will not stop drunk drivers, but establishments will be very reluctant to serve more than one drink, or pay to have an “Alcohol monitor person” testing all alcohol drinkers…” Alcohol Police ” might even close lot business, but ? take your pick – can not have it both ways… Already laws against anyone serving or aiding a minor in the procurement of alcohol. So many people are totally irresponsible and there are also the totally responsible that like a little drink here and there. problem will always be – it impairs, so this is not rocket science. I do not believe we can legislate good responsible behavior either – So- what the heck.. Bring on the Cash and bad accidents we see each and every day – just hoping that no one I know or anyone they know is a victim, well you all too. Oh yea, Please do not drink – impair oneself and Drive.
Take them all off the road..take away their cars, fine them heavily on the first offense and if they are caught driving a friends or family members car, fine the owners and the driver equally….get tougher until these idiots have no vehicles left to drive!
Friends and family usually know when a person has had a DUI or a DWI so I have to conclude that they know there is a greater possibility that the Offender is likely to drink and drive.
I do not know if it would be legally possible but to me they are just as culpable/negligent as the offender is.
