On January 25, 2024, at approximately 3:20 a.m. Montgomery County Sheriff’s Office Deputies and Officers with the Splendora Police Department responded to the 22000 block of Morgan Cemetery Road, Cleveland, Texas, in reference to an assault with a firearm call.
The call originated from a female who called 911 and advised that three males with ski masks entered her home and shot her husband multiple times before leaving the residence. Splendora Police Officers were nearby and observed a vehicle occupied by three males driving at a high rate of speed and pulling into a nearby gas station. Officers attempted to make contact with the males, but two of them drove away in the car, leaving the third suspect at the gas station. Officers pursued the vehicle a short distance before the vehicle crashed at U.S. 59 and Fostoria Road, where both suspects were placed in custody after a brief foot pursuit.
All three suspects are being charged with Capital Murder and have been identified as 26-year-old Andre Franklin, 27-year-old Derrick Williams, and 23-year-old Jose Gutierrez, all from Houston, Texas. All suspects have served time in prison and have extensive felony criminal histories for violent offenses in Harris County. The deceased male has been identified as 37-year-old Steven Santillan from Montgomery County, Texas.
On April 24, 2025, wanted fugitive Anthony Lawrence Green was located and arrested in New Orleans, LA. by US Marshals and Task Force Officers as a direct result of a Multi-County Crime Stoppers tip. The arrest was made possible through the combined teamwork of the Montgomery County District Attorney’s Office, Montgomery County Sheriff’s Office Detectives, USMS members, and Task Force Officers. 31-year-old Green was wanted for Capital Murder by Terroristic Threat in Montgomery County.
Currently, Andre Franklin, who was charged with Capital Murder By Terror Threat/Other Felony, is due in court on May 27, 2025, and he remains in the Montgomery County Jail on a no bond. Jose Patricio Gutierrez Jr., 23, remains in the Montgomery County Jail on a $350,000 bond. He is charged with Capital Murder By Terror Threat/Other Felony. Derrick Williams also remains in the Montgomery County Jail on a $250,000 bond. He is charged with Capital Murder By Terror Threat/Other Felony
