GAME WARDEN ASSAULT UPDATE

On July 7, 2018, at about 8:50 pm, a Game Warden with Texas Parks and Wildlife attempted to stop a side-by-side ATV that was operating on a public roadway near Sorters Road and Ravenwood Dr. in Porter, Texas. The ATV operator refused to stop and led the Game Warden on a chase into a materials plant near Sorters Road. The Game Warden was able to stop the ATV at the dead end of the private drive and made contact with the operator, who refused to exit the vehicle. The Game Warden attempted to detain the operator from the ATV, at which time the operator intentionally drove off, dragging the Game Warden. While being dragged, and fearing for his life and safety the Game Warden fired a single shot from his duty weapon, in an attempt to stop the assault on him. Neither the driver of the ATV or any occupants were struck by the discharging of the firearm. The Game Warden was able to get free from the ATV and received minor injuries as a result of being dragged by the ATV.

Numerous law enforcement agencies responded to the scene in an attempt to locate the ATV and its occupants. At about 4:30 am the ATV operator, 33 year old David Marshall Joucken, was found hiding in the woods with the ATV on the materials plant property and taken into custody for Evading Arrest in Motor Vehicle and Aggravated Assault on a Public Servant.

The Montgomery County Sheriff’s Office, Texas Rangers, Montgomery County District Attorney’s Office and Precinct 4 Constables all responded to the scene and are investigating the Officer Involved Shooting.
