MAN CHARGED WITH KILLING TWO AND INJURING ONE IN A CRASH WHILE INTOXICATED IS ARRESTED FOR DWI

Brian Drew Goetz,  of Magnolia, was arrested by DPS and booked into the Montgomery County jail on two charges of Intoxication Manslaughter with a Vehicle in 2012. Goetz was the driver of the truck that was northbound on Nichols-Sawmill Road on Friday, October 26, 2012 that left the roadway crashing through a fence. When EMS arrived on the scene they found Tori Tabor, 19, of Magnolia being given CPR by bystanders but was pronounced dead on the scene. Audrey Trent, 20, also of Magnolia was seatbelted in the front center seat and suffered severe trauma,. She was transported to Hermann Hospital in Houston by Life Flight. Kevin Hansen, 20, of Magnolia was sitting in the right front passenger seat. He was not wearing a seatbelt and was ejected almost twenty feet into the woods. Pieces of his clothing hung in the tree almost fifteen feet off the ground. MCHD transported him to Tomball Hospital where he was pronounced dead. Goetz, who was sitting in the ditch near the vehicle was transported by Northwest EMS to Houston NW Medical Center in stable condition. DPS Sgt. Schneider traveled to Houston Northwest Medical Center to interview Brian Goetz   Once there he observed Goetz had a strong odor of alcohol on him and his eyes were bloodshot. He admitted to Sgt. Schneider that he had been drinking. A mandatory blood draw was done which resulted in a blood alcohol level of .184. Texas law considers .08 as being intoxicated. Goetz was more than twice that amount. At the scene, Troopers recovered an open “Coors Lite” cardboard container along with several empty beer cans of the same brand. Troopers also found a cardboard container used for packaging wine coolers near the front bumper of the vehicle. Goetz was indicted by a Grand Jury and in 2016 the case went to trial. After a jury trial evidence was introduced that the truck Goetz was driving had a defective front-end component. Testimony was introduced that showed at the time of the crash there was a drop-off on the pavement on Nichols Sawmill and as the truck slipped off Goetz attempted to pull it back on. That was when the component broke and caused the crash. The jury refused to come back with a guilty verdict but did find him guilty of driving while intoxicated. He was sentenced to 6-months in the Montgomery County Jail on November 9, 2016, just over 4-years after the crash.  Early Tuesday morning a Montgomery County deputy arrested Goetz , who is now 30-years-old, on FM 1097 near Pelican Bay. He was found to have been driving while intoxicated and transported to the Montgomery County Jail on a charge of driving while intoxicated second. His bond was set at $1000.
