Metcalf Files Legislation to Create Probate Court in Montgomery County

AUSTIN – State Representative Will Metcalf (R – Conroe) has filed House Bill 1436 to address the growing needs for a specialized probate court to address and serve the needs of the county’s growing population.

Representative Metcalf expressed, “As our community has faced an explosion of growth in the last couple of decades, our local courts have wisely organized themselves to stay in step with that growth and move cases as quickly and expeditiously as possible.” Metcalf continued, “the growth in our county has led to the need for a fully dedicated probate court to manage the increased caseload. To that end, I filed House Bill 1436 to redesignate County Court at Law No. 2 of Montgomery County as Probate Court No. 1 of Montgomery County.”

Judge Claudia Laird presides over the current County Court at law No. 2 of Montgomery County and stated, “We are so very happy to work with Representative Metcalf on this next phase of moving our courts forward.  The addition of a statutory probate court to our courthouse will allow for the continued focus and funding that our guardianship cases need and deserve.”

HB 1436 redesignates County Court at Law No. 2 of Montgomery County as Probate Court No. 1 of Montgomery County. This legislation will not result in a new term of office nor a new judge. This bill  converts the County Court at Law No. 2 into the Probate Court No. 1 of Montgomery County. It gives the court jurisdiction over all estates, wills, and guardianship matters.
