MONTGOMERY COUNTY INDICTMENTS FOR GRAND JURY OF OCTOBER 12, 2010

The new Grand Jury which has completed it’s first week true billed several cases in Montgomery County Tuesday. They are as follows:

Whitaker,JimmyR. Jimmy Whitaker Jr. age 39 of Diamond Creek Road in Magnolia was re-indicted on a charge of DWI Third or More in which he was arrested on December 26, 2009 and first indicted on May 25, 2010.

 

 

Elizabeth Serna, age 32, of Huckleberry Lane in Porter was indicted on a charge of DWI With a Child in the vehicle. She was arrested on June 30, 2010.

Misty A. Russell, was indicted on a charge of Forgery. That case was from June 30, 2010.

Victor H. Mancers was indicted for a July 12, 2010 arrest of Tampering With Physical Evidence.

John C. Smitherman, age 23, of Rosholt Drive in Spring was indicted on three separate offenses of Possession of a Controlled Substance from July 21, Burglary of a Building from August 16 and Credit/Debit card abuse on September 25, 2010. He remains in the Montgomery County Jail on bonds totaling $53,500.

Stephanie M. Daigle, age 30 also of Rosholt Drive in Spring was indicted on two counts of Credit/Debit card abuse.She remains in the Montgomery County Jail on two counts of credit/debit card abuse and with bonds totaling $6000 and fraudulent use/possession of identifying information with a $3000 bond.

Donna M. Powell was indicted on a Theft charge that occurred on August 14, 2010

Jennifer A. Martin, age 19, of Budde Road in Spring was indicted for Possession of Marijuana from an August 29, 2010 arrest. She was released on a $5000 bond.

 

Choate,EdwardC. Edward C. Choate, age age 57, of Anchor Court in Willis has been indicted on a offense of DWI Third or More from a August 29, 2010 arrest. and was released on a $5000 bond.

 

 

Michael T. Mireles, of Grand Bayou in the Woodlands has been indicted for a September 2, 2010 arrest of Evading with a Vehicle.

Korey A. Drumm, age 17 of Edward Street in Houston was arrested September 4, 2010 on a charge of Credit/Debit card abuse and has been indicted.

Yunesis Alvarez, age 17, of Greens Parkway in Houston was indicted on a September 4, 2010 charge of Credit/Debit card abuse while he was at The Main Event. He was arrested by Shenandoah Officer Bledsoe and was released on a $1500 bond.

Marvin Jose Montano-Acevedo, age 34, of Willow Street in Spring has been indicted on fraudulent use of identifying information from September 3, 2010.

Jamal J. Hatchett, age 23, of South 7th Street in Conroe has been indicted on a charge of Theft From a Person which occurred on September 17, 2010.

Daniel Herrera, age 22, of Legends Pine in Spring was arrested on September 22, 2010 and indicted Tuesday on Possession of a Controlled Substance.

Thomas W. Millican, age 48, of Choctaw Drive in Porter was indicted on a Theft charge from September 24, 2010. This charge was a misdemeanor which was enhanced to a felony.

 

Torres,GilbertA. Gilbert Torres, age 30 of South Memorial in Humble was indicted last week on several charges stemming from a June 14, 2010 traffic stop. He was indicted on a Third or More DWI and two additional charges of DWI With a Child. He was released on a PR bond several days later but with several conditions set forth by Judge Kathleen Hamilton.

 

Silva,Ernesto Ernesto Silva age 25, of Hollow Oaks in Porter was also indicted on a charge of DWI Third or More. He was arrested on July 10, 2010, bonded out and was to be in court on September 17 but failed to appear. Judge Seiler issued a Capias for his arrest.

 

 

 

Onesimo Aguilera III of Crockett Crossing in Conroe was indicted on four counts of Aggravated Robbery that occurred on July 12, 2010. His bond was originally set at $50,000 per charge but was reduced to $25,000 per charge with multiple conditions placed on his release including not leaving the county, a curfew at night and avoiding alcohol. Even with those conditions he remains in the Montgomery County Jail.
