MONTGOMERY COUNTY WEEKLY REPORT ENDING AUGUST 31, 2010 FROM LT. DAN NORRIS

District 1 – Lt. Jim Fleming (North County)

On August 23, Deputies S. Squier and K. Berger were sent to investigate a suspicious persons and vehicle call in the area of Andwood and Balsam. The Deputies located a male in the area and during the investigation the male was found to be in possession of a controlled substance. The 24 year old male from Willis was arrested at 12:05am. The Deputies heard a noise in the area and Deputy Berger went to investigate. The Deputy located a female hiding under a porch. During the subsequent search of the female, she was found to be in possession of a controlled substance, two different dangerous drugs and marijuana. The 32 year old female from Willis was arrested and charged with the possession of each. Both male and female were taken to jail.

On August 23, Deputy S. Degner stopped a vehicle speeding in excess of 100 mph in a 55 mile per hour zone in the intersection of SH 242 and Mystic Hill. The male driver had been drinking to the point of intoxication. The 41 year old male from Conroe was arrested at 11:05pm for DWI and two traffic warrants out of Conroe PD and taken to jail.

A 44 year old male from Willis was arrested at 12:43am, August 25, in the 13600 block of Big Horn Trail by Deputy S. Squier for a fugitive from justice (felony non-support) warrant out of the State of Michigan. The Deputy had received information on the location of the male. The male was transported to jail.

A 33 year old male from Willis was arrested at 1:10am, August 25, in the area of Calendar Road and Andwood Road by Sgt. J. Varnell for a theft warrant out of Montgomery County. The male was located walking down the road. The male was transported to jail.

A 35 year old male from Willis was arrested at 2:23am, August 26, in the 15300 block of Arrowhead Bend by Deputy S. Squier for a blue warrant (parole violation) out of TDCJ Austin. The Deputy was on a warrant service. The male was transported to jail.

A 26 year old male from Conroe was arrested at 10:40pm, August 26, in the area of FM 1484 and FM 3083 by Deputy J. Kader for a reckless driving warrant out of Montgomery County. The male was stopped on a traffic violation. The male was taken to jail.

On August 26, Deputy J. Kader stopped a vehicle on a traffic violation in the area of Amblewood and Barberry. During the ensuing investigation it was found the male driver was in possession of marijuana. The 33 year old male from Willis was arrested at 1:32pm and transported to jail.

A 34 year old male from Willis was arrested at 3:29pm, August 26, in the 7000 block of Kingston Cove Lane for a theft by check warrant out of Montgomery County. The Deputy was on an investigation involving the male suspect. The male was taken to jail.

On August 26, Deputy J. Bourne was sent to the 13800 block of Henry Harris Road in reference to a disturbance. The Deputy met with a male complainant who advised he was driving down the road when a male suspect came running out on the roadway with a 2 x 4 board and swung the board at the complainant (complainant had gotten out of his vehicle) striking him on the knee. The male suspect then hit the complainant on the face with his hand. The male suspect then went back into his yard and picked up a machete and started waving it. The complainant got back into his vehicle and went home. The suspect fled from the scene. The Deputy searched for the male and found him hiding under an abandoned mobile home. The 52 year old male from Conroe was arrested at 10:45pm, charged with aggravated assault with a deadly weapon and transported to jail. This incident stemmed from a prior problem between the two males involved.

On August 27, Sgt. J. Varnell stopped a vehicle on a traffic violation in the 900 block of IH 45. During the ensuing investigation the male driver was found to be in possession of a controlled substance. The 21 year old male from Houston was arrested at 1:40am and transported to jail.

On August 28, Deputy K. Underwood was notified of a family violence assault in the 13200 block of Sandchester Trail. The Deputy met with a male and his wife both of whom had visible injuries that had been inflicted by each on the other. The 26 year old male and 25 year old female from Conroe were arrested for assault at 4:13am and transported to jail.

A 31 year old male from Willis was arrested at 7:15pm, August 28, in the 12600 block of Lake Conroe Bay by Deputy K. Albritton for a theft by check warrant out of Williamson County. The Deputy was investigating a runaway. The male was taken to jail.

On August 28, Deputy D. Pena was sent to the 10500 block of Royal Terrell Drive for a noise disturbance. As the Deputy was leaving the area a male was observed laying in the ditch near the roadway. The male was observed to be intoxicated. The 65 year old male from Conroe was transported to jail.

On August 28, Deputy S. Degner stopped a suspicious vehicle in the area of Dusty Lane and Waukegan. The male driver was found to be intoxicated. The male had two previous convictions for DWI and also had a felony surety to surrender warrant out of Rains County. The 52 year old male from Conroe was arrested for DWI and the warrant at 11:17pm and transported to jail.

On August 29, Deputies S. Squier and K. Berger observed a traffic violation in the intersection of Hwy 105 and Crockett Martin. The vehicle pulled into a service station. The male driver was found to be intoxicated and was detained. During the investigation the male passenger was found to be in possession of marijuana. The 42 year old male driver from Cleveland was arrested at 11:30pm for DWI and the 60 year old male passenger from Conroe was arrested for possession of marijuana. Both males were taken to jail.

District 2 – Lt. Brady Fitzgerald (South County)

On August 21, 2010, Sergeant Gonzales and CSI Wallace were working an approved extra job at 305 Sawdust Road. At approximately 2 am, while directing all the patrons out of the building due to closing, CSI Wallace noticed a, White Female 20 yrs old from Houston, subject refusing to leave. After repeatedly asking and then demanding the suspect to leave, the suspect swung at CSI Wallace’s face and head striking him several times. At that time, the suspect was placed into custody charged with Criminal Trespass (for refusing to leave), Public Intoxication and Resisting Arrest. While CSI Wallace was struggling with and handcuffing the suspect, the suspect’s husband, White Male 24 yrs old from Houston, attempted to intervene and was detained by Sergeant Gonzales. He was issued a Criminal Trespass Warning for the location, and charged with Interfering with the Duties of Public Servant. Both were transported to the Montgomery County Jail in Conroe.

On August 26, 2010, Deputies Fruge, Mitchell, Roberts and Sergeant Mullis responded to a robbery call at 25650 I-45 North. The complainant advised that while sitting in his vehicle, he was approached by a Black Male wearing a security shirt. The suspect demanded his driver’s license and registration. The complainant then exited his vehicle and produced his wallet to retrieve the requested documents. At that time, the suspect took the wallet out of his hands and then put the complainant against the vehicle. The suspect then left the scene with the wallet. Deputy Mitchell later located a person fitting the description of the suspect. The person was detained and the complainant positively identified him as the actor by his face, and distinctive clothing. The suspect, Black Male 43 yrs old, had lived on the property for approximately 2 weeks as the onsite security officer. He was wearing a t-shirt that said “police I am the law”. Sergeant Mullis conducted a lengthy interview with the suspect, as well as his family. There were numerous discrepancies in their stories. The District Attorney’s Office was contacted and the subject was arrested for Impersonating a Peace Officer and Theft from a Person. He was transported to the Montgomery County Jail without incident.

On August 29, 2010, Sergeant Hammons, while on patrol in the area of Sawdust and Grogan’s Mill, observed a vehicle traveling west on Sawdust Road. The windshield of the vehicle was bashed in directly in the driver’s side view. At that time, Sergeant Hammons ran the vehicle license plate and found that the insurance for the vehicle was expired and proceeded to conduct a traffic stop on the vehicle. During the course of the traffic stop and investigation, Sergeant Hammons, with the assistance of Sgt. Wilkins, Deputy Everton and K-9 Ranger, found that the passenger, White Female 33 yrs from Conroe, was in possession of .08 grams of Methamphetamine. She was taken into custody, charged with Possession of a Controlled Substance and transported to the Montgomery County Jail without incident.

On August 29, 2010, Deputy Fruge responded to 3411 Rayford Rd in reference to a Burglary of a Building. Once on scene Deputy Fruge learned that several storage units had been burglarized. Deputy Fruge was able to make contact with three complainants. While working on his investigation, one complainant contacted Deputy Fruge by phone and advised him that he was following the actor vehicle from the burglary into Harris County. The complainant was advised to contact Harris County Sheriff and continue to follow only if he felt safe. The complainant continued to follow and they arrived at the E-Z Pawn located at 1991 FM 1960 W (Harris County). Harris County arrived and detained the suspect, White Male 28 yrs old from Spring, TX, as he was preparing to pawn stolen items from the burglary. The complainant was able to identify several pieces of his stolen property in the suspect’s vehicle. Deputy Fruge responded to the E-Z Pawn and made contact with his complainant and suspect. The District Attorney’s Office was contacted and accepted charges for Burglary of a Building (3 counts). The suspect was transported back to Montgomery County and booked into the jail. He also had an outstanding warrant for theft.

On August 20, 2010, Deputy Pierman responded to 1025 Sawdust Road in reference to a 52 year old Black Female from Spring, being detained for shoplifting. The suspect attempted to steal approximately $155.50 in merchandise from Wal-Mart. The suspect was transported to the Montgomery County Jail without incident.

District 3 – Lt. Darrel Conn (East County)

On 8/24/10 Deputy Ortiz was dispatched to the 23000 block of Hwy 59 in reference to a welfare check. A call was received that a mother was highly intoxicated and not caring for her one year old child at the swimming pool. Bystanders had to remove the child from the water several times due to the mothers’ state. When Deputies arrived they found the mother and child had returned to their apartment. They made contact with the female and found her to be highly intoxicated. The mother also did not know where her 10 year old child was at. Deputies found the one year old on the bed crying. The suspect, a 34 year old female was arrested and charged with Child Endangerment, a 2nd degree Felony. The 10 year old was located and both children were released to a relative.

On 8/26/10 Deputy White responded to the 20000 block of Mizell Rd. in reference to a suspicious person call. A School District Officer had observed a male loading up a riding lawnmower from the woods. The Deputy arrived on scene and observed that the suspects vehicle had the inspection sticker from another vehicle on the windshield. The lawnmower is believed to be stolen but had not been reported or entered stolen as of that time. The suspect, a 29 year old male was arrested and charged with Ficticous Inspection Sticker.

On 8/27/10 Sgt. Armstrong was on patrol and observed a vehicle travelling on FM 1314 at a high rate of speed. A traffic stop was conducted on the vehicle. Contact was made with the driver and he showed signs of intoxication. Field sobriety tests were given and the driver was determined to be intoxicated. The driver was taken into custody and his vehicle was inventoried and towed. During a search of the vehicle Xanex pills and Vicodin pills were located in the console and there was no prescription. Upon arrival to the jail two more Vicodin pills were located in the suspect’s wallet. The suspect, a 53 year old male was arrested and charged with DWI (3rd or more) and Possession of a Controlled Substance.

On 8/31/10 Deputy Amstutz was on patrol and received a call about a white truck driving all over the road in the area of loop 494@ F.M. 1314. The Deputy then observed the truck in the area and the driver drove into oncoming traffic lanes and then stopped the vehicle partially in the intersection and the side of the road. The Deputy approached the driver and observed him to now be asleep behind the wheel. The driver was awakened and showed signs of intoxication. Field sobriety tests were given and the suspect was found to be intoxicated. The driver, a 36 year old male was arrested and charged with DWI.

District 4 – Lt. David Park (West County)

On August 29th Deputy Zavorski was in the area of Carraway Lane in reference to a disturbance involving a 60 year old male subject. Deputy Zavorski located the subject walking around his vehicle in the parking lot of the El Pichon Taqueria located in the 9000 Block of Carraway Lane. The subject was at a business trying to close for the night and has just left a residence across the street where he had been asked to leave for being belligerent. The Deputy observed the subject to have red blood shot eyes, slurred speech and a strong odor of alcoholic beverage coming from his breath and person. The subject was unable to balance while standing on his own. The subject was arrested and charged with Public Intoxication. He was transported to the Montgomery County Jail.

On August 28th Deputy Zavorski was dispatched to the 28000 Block of Autumn Lane in reference to a Disturbance. The Reportee advised that a female had been driving in reverse down Autumn Lane and collided with the back of his wrecker that was parked on the street. The Reportee stated there was no damage to either vehicle, but a verbal disturbance started . Deputy Zavorski located the female sitting in her vehicle in the driveway of an abandoned home on Autumn Lane. While speaking to the female subject the Deputy observed 15 to 20 red circle shaped pills on the passenger floorboard and an open prescription pill bottle in plain view. A prescription bottle with the label torn off was in the Glove Box containing 4 ½ Lorecet pills. Also a bottle with a partial label containing 2 ½ Xanix pills was on the center console. The female subject was arrested for Possession of Controlled Substance and transported to the Montgomery County Jail.

On August 27th Deputy Crandell was dispatched to a Warrant Service at the Magnolia Library on Melton Street. The 43 year old male subject was on location using the phone to call the Complainant from a Family Violence offense that had occurred the previous day. On August 25th the subject had thrown an office chair at the female Complainant hitting her in the left upper leg just above her knee. On the 26th the subject had also assaulted her until her son intervened and forced the subject to leave the residence. The subject was arrested and charged with Assault Family Violence and an outstanding warrant for Theft of Property by Check. He was transported to the Montgomery County Jail.

On August 26th Deputy Zavorski went to the 7600 Block of Red Bay Circle in reference to a Warrant Service. Upon Arrival Deputy Zavorski made contact with the 19 female subject and confirmed her active warrant for Delivery of Controlled Substance. The subject was taken in to custody and transported to the Montgomery County Jail.

On August 26th Deputy Zavorski was dispatched to the Turtle Creek Subdivision in reference to a Family Disturbance. The reportee advised that a male subject and his wife were arguing and the wife had started shooting a handgun into the air while standing in their backyard. Upon arrival Deputy Zavorski made contact with both parties who advised they had been drinking and began arguing. They advised it had become a heated verbal altercation, but did not get physical. The wife a 58 old female subject walked outside with a loaded 40 caliber Smith and Wesson and fired it into the air while she yelled at her husband. The female subject was arrested for Discharging a Firearm on less Than 10 Acres and transported to the Montgomery County Jail.

On August 25th Sergeant Russell was dispatched to a possible intoxicated driver. A witness had observed the vehicle driving poorly, swerving outside his lane and striking a curb on Woodlands Parkway. The Sergeant was able to catch up to the vehicle and followed it. He observed the vehicle travel outside the marked lane of travel several times. A traffic stop was conducted at which time the Sergeant noticed a moderate odor of an alcoholic beverage emitting from the breath of the driver. A field sobriety test was performed and a breath sample taken. The Driver was a 22 male subject was arrested for DWI and transported to the Montgomery County Jail.

On August 25th Deputy Birch while on patrol in District 4 was dispatched to the 22000 Block of Schneider Circle in reference to a disturbance. Upon arrival Deputy Birch met with a 50 year old white male subject. After running the subject’s ID information through Dispatch it was discovered the subject had an outstanding warrant for Theft out of Nueces County. The subject was transported to Male Booking at the Montgomery County Jail.

On August 23rd Deputy Zavorski went to the 18000 Block of Turtle Creek Way to make contact with a male subject and take him into custody for a Failure to Stop and Render Aid Warrant and an Evading with Vehicle Warrant. Deputy Zavorski made contact with the 26 male subject, confirmed the warrants and transported him to the Montgomery County jail.

District 5 – Lt. Don Lacy (Northwest County)

On 08/26/10 Deputy Rex responded to the 25900 block of SH 105 W in regards to a Verbal Disturbance. Investigation revealed that a male and female had been involved in a verbal altercation. A check of both subjects revealed that the male had two outstanding warrants through Walker County for Theft and Harassment. The male subject was arrested for the warrants and placed into the Montgomery County Jail on undetermined bonds.

On 08/27/10 Deputy McCarthy responded to the Scotts Ridge Boat Ramp facility located in the 12900 block of Scotts Ridge on Lake Conroe to conduct routine area patrol. Contact was made with an adult male in the area and upon checking it was revealed that this individual had an outstanding warrant for Driving While Intoxicated. The subject was arrested for the warrant and placed into the Montgomery County Jail on $500 bond.

On 08/27/10 Deputy Lennon met with a female complainant from the 27900 block of Deer Run in regards to Violation of a Protective Order. The complainant reported that her estranged husband has come to her residence on numerous occasions for the purpose of harassing her which is in violation of the Protective Order she had issued against him.

Deputy Lennon prepared a report outlining the recorded violations and forwarded the case to the District Attorney’s Office for consideration of charges for Violation of a Protective Order, Misdemeanor A.

On 08/27/10 Deputy Garner conducted a Traffic Stop in the 18000 block of SH 105 W. After making contact and speaking with the female driver, Deputy Garner had reason to believe that she may be under the influence of alcohol. Therefore, the driver was administered several standard field sobriety tests. Subsequently the driver was arrested for Driving While Intoxicated 2nd Offense and placed into the Montgomery County Jail on $1,000 bond.

On 08/28/10 Deputy Rex conducted a Traffic Stop in the 16200 block of SH 105 W. Upon making contact with the male driver it was suspected that the subject may be intoxicated. The subject was administered several standard field sobriety test and later arrested for Driving While Intoxicated and placed into the Montgomery County Jail on $600 bond.

District 6 – Lt. David Dottei (Woodlands)

On 8-25-20 at approximately 2100 hours, Deputy Knight attempted to stop a white SUV for expired registration. The driver of the vehicle then pulled into her residence. The females exited the vehicle. Deputy Knight ordered the females to stop and the female later identified as the driver/ Hispanic Female 29 years old from Stafford, refused and continued inside the residence. The passenger was detained and identified as White Female 25 years old from Conroe, provided false information as to who was operating the motor vehicle, in order to give the first female time to get away from Deputy Knight. When faced with arrest, she changed her story. Several units arrived on scene and the driver later exited the residence. A strong odor of an alcoholic beverage was coming from her breath. The driver admitted to driving the vehicle, but later changed her statement. She was given several Field Sobriety Tests and due to her poor performance of these tests, was placed into custody for DWI. The DA’s Office also accepted charges for Evading arrest. The charge of Hindering Apprehension was accepted on the passenger. Both were transported the Montgomery County Jail without incident.

On August 23, 2010, while on patrol in the High Oaks subdivision, Deputy Uber observed two males standing in the front yard of a residence drinking beer and both subjects appeared to be under age. Deputy Uber approached the two males asking for identification. One of the males walked away towards the house, refusing to comply with Deputy Uber’s commands to come back. After other units arrived to assist, Deputy Uber made contact with the first suspect, Black Male 19 yrs old from Houston, and again asked for identification. The suspect stated his name and date of birth, advising Dep. Uber he did not have any identification. Dispatch was unable to locate any information on a person with that information. During the course of the investigation, the suspect was found to have a driver’s license on his person as well as a digital scale commonly used to weigh marijuana. The driver’s license gave a different name and date of birth. Deputy Uber contacted the District Attorney’s Office and charges were accepted for Failure to Identify. The other subject was found to have .141 oz of marijuana in his pocket. He was charged with Possession of Marijuana. Both were transported to the South Montgomery County Jail without incident.

On August 23, 2010 at approximately 8:22 p.m., Deputies were dispatched to a disturbance in progress located on Country Forest Ct. in the Woodlands where a male was screaming that he was going to kill someone. While Deputies Lawless and Carson were enroute to the scene Deputy Lawless was given an actor description. At 8:29 p.m., Deputy Lawless advised dispatch that he was out on traffic on the possible actor as the suspect exited his vehicle with clenched fists and began to approach Deputy Lawless. Deputy Lawless exited his car and began to issue commands for the suspect to turn around. The suspect did not comply and he continued to advance towards Deputy Lawless. As Deputy Lawless tried to handcuff the suspect he continued to be belligerent and began to resist. When Sgt. Gonzales arrived on scene he observed Deputy Lawless and the suspect fighting on the ground. The suspect tried on several occasions to take Deputy Lawless’ firearm from his holster. Deputy Lawless and Sgt. Gonzales were then able to handcuff the individual. The suspect, White Male 59 years old from Lanford Port London, was transported to the Montgomery County Jail where he was booked on Attempting to Take a Weapon from a Peace Officer and Assault on a Public Servant.

The following Shoplifting arrest(s) were made:

8/20 – Deputy Ross responded to 1201 Lake Woodlands in reference to a 16 year old Black Male from Conroe, being detained for shoplifting. The suspect attempted to steal approximately $50.00 in merchandise from Sears. The suspect was transported to the Montgomery County Juvenile Detention Facility in Conroe.

8/22 – Deputy Houstoun responded to 3040 College Park Drive in reference to a 23 year old White Male from Conroe and a 25 year old White Male from Conroe, being detained for shoplifting. The suspects attempted to steal an Xbox 360 Wireless Network valued approximately $199.92. The suspects were transported to the Montgomery County Jail without incident.

8/24 – Deputy Weatherford responded to 1201 Lake Woodlands in reference to a 61 year old White Female from Montgomery, being detained for shoplifting. The suspect attempted to steal approximately $60 in merchandise from Macy’s. The suspect was transported to the Montgomery County Jail without incident.

8/25 – Deputy Knight responded to 3040 College Park Drive in reference to a 22 year old Hispanic Female from Conroe and a 29 year old Hispanic Female from Conroe, being detained for shoplifting. The suspects attempted to steal several DVDs, children’s clothing and other items, valued approximately $498.67. The suspects were transported to the Montgomery County Jail without incident.

8/27 – Deputy Ross responded to 1201 Lake Woodlands in reference to a 35 year old White Female from Spring, being detained for shoplifting. The suspect attempted to steal approximately $116.55 in merchandise from Macy’s. The suspect was transported to the Montgomery County Jail without incident.
