Montgomery Man Sentenced to 15 Years for Fatal Crash

On July 29, 2021, Joshua Alan Mann, 41 years of age, from Montgomery, was sentenced to 15 years in prison for Intoxication Manslaughter and 10 years in Intoxication Assault for a crash on February 10, 2019, in Montgomery, TX. The range of punishment for Intoxication Manslaughter is 2 to 20 years in prison and 2 to 10 years in prison for Intoxication Assault. The 435th District Court imposed the sentences according to the plea agreement. As the agreement included an affirmative finding of a deadly weapon, Mann will have to serve half of his sentence before being eligible for parole.
The deadly crash occurred shortly before 1:00 pm on Sunday, February 10, 2019, on SH 105 in Montgomery. Mann was driving erratically and traveling westbound on SH 105 when he crossed into oncoming traffic and struck an eastbound vehicle head-on, killing the front seat passenger – Amanda Tomkivits – and severely injuring the driver, Janet Sunday, and the back passenger, Ashley Jones. The investigation revealed that Mann was intoxicated on methamphetamine and alprazolam at the time of the crash. After the court pronounced Mann’s sentence, Ashley Jones delivered a powerful victim impact statement on behalf of herself, her mother Janet Sunday, and her cousin Amanda Tomkivits.
The Montgomery Police Department, with the assistance of the Department of Public Safety, Montgomery County Sheriff’s Office, and Montgomery County District Attorney’s Office Vehicular Crimes Team investigated the crash.
Vehicular Crimes Chief Andrew James: “Joshua Mann is going to prison because of his choices. Because of his choices, a young mother is gone; two innocent women suffered debilitating and permanent physical injuries, and two families are forever devastated. This substantial sentence was the direct result of the great work of the Montgomery Police Department, the Department of Public Safety, and the Montgomery County Sheriff’s Office. Their hard work allowed our office to hold Joshua Mann accountable for his crimes.”
