At 9 p.m. Thursday night Deputy Juan Chapa with the Montgomery County Precinct 4 Constables Office was traveling northbound on US 59 near Fostoria when he observed a 1999 Oldsmobile Alero traveling over the posted speed limit. He stopped the vehicle and identified the driver and passenger. Upon questioning the driver said he had gone to Houston to get a clam and a mushroom for his aquarium in Nacogdoches, Texas where he lived.
Something didn’t set right with Deputy Chapa since the female passenger told him they had gone to buy fish for the aquarium. There were no fish present in the vehicle. He asked the driver if he had anything in the vehicle which the driver stated he did have a handgun and allowed Deputy Chapa to remove it. He would not consent to a search of the vehicle.
Deputy Chapa then deployed his K-9 partner, Porter who immediately alerted to the presence of some type of drug. Now having probable cause to search the vehicle Chapa discovered 2 one gallon bags of marijuana weighing one pound each.
The driver identified as Schylur Johnson, 24 of 2120 Pearl Street in Nacogdoches was arrested and booked into the Montgomery County Jail on the charge of possession of marijuana more than 4 ounces but less than 5 pounds. This is a State Jail Felony in which he could serve up to 2 years in State Jail. He advised Chapa he was unemployed at this time.
The female was not charged in the incident.
