On  February 22, 2012 at approximately 4:15a.m the Liberty County Sheriff’s Office received a call in reference to a shooting which had just occurred on State Highway 321 and County Road 2274.  The complainant indicated to the dispatcher two males in a black over tan Ford Expedition had pulled onto his property.  Both men exited said vehicle and began to steal a welding machine from his property.

The Complainant then exited the residence armed with a fire arm and discharged the weapon towards the two men and their vehicle.  The complainant indicated the suspects jumped back into the vehicle and  fled south on Highway 321 towards the F.M. 1960 – Highway 90 area.

A short time later, approximately 5:00a.m. the Harris County Sheriff’s Office received a call on Highway 90 near Beltway 8 where a black over tan Ford Expedition was on the roadway and a male near the vehicle had a gunshot wound.  Based upon the similarities of the vehicle and damage to the vehicle, as indicated by the complainant in Liberty County, Detectives from the LCSO contacted the                  Harris County Sheriff’s Office and now both Agencies are working together in an attempt to further process this case.

At this time the identity of the male with the gunshot wound is not being released as the investigation remains open and active.  Deputies are also looking for the second male suspect from the incident in Liberty County.  The Complainant in this incident is not currently facing any criminal charges, however, at a later time in the investigation process, this case could go before a Grand Jury for review.

Deadly force requires a threat to one’s life or safety. Mere theft does not justify deadly force. Read 9.22 in the Texas Penal Code. Can you shoot the kid next door for stealing your garden hose after dark? Of course not, in spite of what all the internet commandos tell you.

Why? 4:15 A.M. they were stealing, last I heard in Texas you could defend your property. So why would the home owner faces charges. This gives crimnals a free pass.
