Montgomery County Pct 4 Constable Kenneth “Rowdy” Hayden reports the
Following events for the date of 12/29/09 – 01/05/10

Montgomery County Constable Pct. 4 Deputies served 24 civil papers throughout East Montgomery County leaving 27 pending. There were 10 evections served. Captain Moody is in the process of serving 2 writs. Montgomery County Pct. 4 Constable’s office made several arrests, from these arrest 18 JP 4 warrants were cleared. The Deputies also arrested 1 person for an outstanding Montgomery County misdemeanor warrant.

No Driver’s License, No Insurance, No Way
8 vehicles were towed in East Montgomery County for no DL and no insurance and 42 citations were issued to the drivers for traffic violations. 10 other vehicles were towed after the driver’s were arrested during a traffic stop. 1 vehicle was towed as it was abandon and caused a traffic hazard, and 1 stolen vehicle was recovered, the driver was arrested.

Fake ID
On 12-31-09 at 7:00 pm Deputy Sapp and Deputy Morrow conducted a traffic stop on a red truck in the Fire Tower Rd. area. The driver gave Deputies a paper driver’s license that did not belong to him. After further investigation Deputies learned that 20 year old Brian Hardin was not telling the truth about his identity. Brien was arrested for Fruad use of identifying information which is a State Jail Felony. He was transported to the East Montgomery County Jail.

Public Intoxication
On 01-01-10 at 4:00 am Deputy Bergland was investigating a stolen vehicle case when he noticed a white male asleep in the back seat of the stolen car. The male was very intoxicated and appeared to be a danger to him self as well as others. The male was identified as 28 year old Eric Landry. This person was too intoxicated to give the Deputy his home address. Eric was arrested for public intoxication and transported to the East Montgomery County Jail.

On 01-01-10 at 7:45 pm Corporal Looza responded to a trespasser call at the Stop and Drive gas station located on Lp 494 in Porter. Corporal Looza arrived on scene and was advised by the clerk that a white male was very intoxicated inside the store causing a disturbance. The suspect exited the store and went behind the business. Corporal Looza went behind the store and made contact with the suspect. The suspect then got onto a bicycle and rode away very fast. Corporal Looza chased the suspect on foot and caught the suspect. This person was identified as 40 year old Timothy Grimes. Further investigation revealed marijuana in the suspect’s cloths pocket. Timothy was arrested for possession of marijuana, evading arrest, and public intoxication. He was transported to the East Montgomery County Jail.

No Refusal DWI Enforcement
Pct. 4 Constable’s Office worked with the Montgomery County District Attorney’s Office during the New Year’s Eve Weekend. 17 patrol units from the Constable’s Office hit the streets of East Montgomery County in search of intoxicated drivers. With over 45 traffic contacts 5 DWI arrest were made by Pct. 4 Deputies. The Pct. 4 Deputies also assisted with several other DWI arrest for other Law Enforcement agencies.

On 12-31-09 at 8:00 pm Deputy Rivera responded to a vehicle in Splendora that was reported to have crashed into the guard rail on Hwy 59 near Creek Wood Dr. Deputy Rivera made contact with the driver of a blue truck who appeared to be intoxicated. The driver had to hang onto his vehicle to keep from falling down on the side of the road. The driver was identified as 52 year old Claburn Gibson from New Caney. Gibson thought he was in Porter Tx. Gibson failed several roadside field sobriety test. Gibson was charged with DWI. Further investigation lead Deputy Rivera to upgrade the DWI charge to a felony DWI since he had several prior DWI convections. Gibson was transported to the East Montgomery County Jail.

On 12-31-09 at 11:50 pm Corporal Looza assisted Constable Hayden with a traffic stop after a vehicle was observed traveling down FM 1485 in New Caney with no head lights on. The driver was identified as 36 year old Jack Smith from New Caney. Jack failed several field sobriety test and was placed under arrest for DWI. A breath test at the station showed that Jack was 3 times over the legal limit of his blood alcohol content . Jack was placed into the East Montgomery County Jail. His bond was set at $600.00

On 01-01-10 at 1:30 am Deputy Sapp and his partner Deputy Morrow conducted a traffic stop on a red truck that was found to be parked in a moving lane of traffic causing a traffic hazard. The driver of this truck was identified as 35 year old Deborah Turnbull from New Caney. Turnball appeared to be very intoxicated. Turnball stated to the Deputy “just take me to jail” Turnball was given several field sobriety test, which she failed. She gave a breath test that at the station which showed her blood alcohol content to be over the legal limit. She was arrested for DWI and transported to the Montgomery County Jail.

On 01-01-10 at 4:00 am Deputy Rivera assisted Constable Hayden with a traffic stop, after a gray Jeep lost control on Lp 494 near Ford Rd. and nearly caused an accident with a marked patrol vehicle. The driver was seen throwing cups of alcohol from the driver’s side window. Deputy Rivera made contact with the driver who was identified as 40 year old Shelly Murphy from Cleveland. Shelly failed several field sobriety test. She was transported to the New Caney DPS office and gave a breath test. Her blood alcohol content was over the legal limit. Shelly was arrested for DWI and transported to the Montgomery County Jail.

On 01-02-10 at 8:00 pm Corporal Looza was dispatched to the New Caney Hwy 59 area in reference to an attempt to locate a silver truck that was involved in a hit and run accident in Harris County. Corporal Looza located the silver truck as it went into a ditch on the highway and caught on fire. Corporal Looza removed the driver from the vehicle as it was burning. The driver appeared to be very intoxicated. The driver was identified 28 year old Michael Kajawa from New Caney. Michael failed several field sobriety test and was transported to the Kingwood ER where a blood sample was given to check his alcohol level in his blood. Michael was charged with DWI and transported to the East Montgomery County Jail. His bond was set at $750.00
