Just after 7:15am Thursday morning a lone gunman walked into the Fostoria Food Mart Exxon on Fostoria Road between I-69 and Morgan Cemetery. He attempted to rob the elderly clerk and then shot him . The male identified as a heavy white male.left in a gray mini-van with no license plates visible fled the scene empty handed.
A Frito Lay delivery driver was outside at the time of the robbery as was a driver who was getting gas and heard the shot. Another person attempted to follow the van. He followed him up until he turned onto CR 3799 off Morgan Cemetery Road.
The clerk who was shot in the leg is in stable condition at Conroe Regional Hospital.
About twenty-five minutes later the same suspect wearing a stocking mask and a blue and white flannel shirt walked into the Circle B Food Mart on the corner of New Salem and SH 105/321, with a .357 he first put it in a customers face then the clerk. He fled with close to $700. Within minutes and with several units in the area the van was intercepted in the 900 block of New Salem Road (CR318) just east of the bypass.
A Cleveland I.S.D. unit found the mask used in the robbery just south of SH 105/321 at CR 2469.
It was then learned that the same male robbed the Gulf Station at Houston and Washington in Cleveland close to 5 a.m. He robbed the clerk of both money and cigarettes.
The suspect has been identified as Daniel Wayne Hornback, 28, of 694 Virginia in Shepherd and formerly lived on Petty Walker in Conroe.
On May 1, 2003 he was sentenced to 1-year probation for assault causes bodily injury. That probation was revoked in November 2004.
Hornback was arrested in March 2006 in San Jacinto County for driving while license suspended.
On May 1, 2007 he was given 2 years deferred probation for possession of marijuana in a school zone once again in San Jacinto County.
On July 24, 2012 he was sentenced to sixteen days in jail after he was charged with driving while license invalid.
On January 24, 2013 he was arrested by Cleveland Police for theft of property and given 1-year probation.
