James Buckner, 57 of Magnolia last talked to his wife as he turned in for the night in a hotel room in which she thought was Waco, Texas. That was on July 9th. The last time Buckner was seen by his wife was on July 6th at which point he was at home and she was going out of town.
Buckner, a salesman for a valve company which sells valves to the wastewater treatment industry was due for a meeting on Thursday July 10th but was not heard from. His wife Kathryn then tried to reach him and unable to reach him notified the Montgomery County Sheriff’s Office.
Montgomery County Sheriff’s Office obtained video from the Valero at FM 149 and SH 105 showing Buckner fueling is truck up the night of the 9th.
Montgomery County Detectives attempted to get phone records from AT+T for Buckner’s phone however AT+T did not comply.
On Sunday, July 28, 2014, Buckner’s wife Kathy contacted Equusearch who immediately went to work on the case.
On Monday they were able to obtain phone records from AT+T through an exigent request.
An emergency situation requiring swift action to prevent imminent danger to life or serious damage to property, or to forestall the imminent escape of a suspect, or destruction of evidence. There is no ready litmus test for determining whether such circumstances exist, and in each case the extraordinary situation must be measured by the facts known by officials
Those circumstances that would cause a reasonable person to believe that entry (or other relevant prompt action) was necessary to prevent physical harm to the officers or other persons, the destruction of relevant evidence, the escape of a suspect, or some other consequence improperly frustrating legitimate law enforcement efforts.
With those records they were able to determine a text was sent to his phone on July 10th. The tower where the signal came from was off Business 59 in the City of Livingston.
A search was started and searchers found Buckner’s white pickup truck in the parking lot behind the La Quinta Hotel in Livingston. Livingston Police were notified and processed the vehicle for any evidence. They also checked security cameras at the hotel but learned their cameras like many others , due to hard drive storage space re-write over previous video every seventy-two hours. They were able to tell the vehicle had been there at least 3 days.
Records were checked and it was determined Buckner never checked into the La Quinta. The hotel was searched but turned up nothing. Kathy Buckner credits Equusearch with being able to find the cell phone location. “If it wasn’t for EquuSearch resources we would still be looking in the Montgomery Area”, Linda Buckner said.
Equusearch, a volunteer organization spent the entire day Wednesday searching. Some volunteers on foot, others on four-wheelers and still another using a drone. Most of the volunteers took off the day from their regular jobs to assist.
They will return to the search on Thursday.
