SECOND PERSON ARRESTED IN 2015 CAPITAL MURDER

Daniel Wade Kirksey, 31, of Conroe was arrested Thursday after being indicted a week before in connection with the November 14, 2015 murder of Marc Pourner.  Marc who worked at Randall’s did not show up for work which was highly unusual. Friends began to search and were not able to locate him.  A report was then made that he was missing from his Spring Home. Montgomery County Detectives talked with several friends and then learned his truck was located along Caney Creek near the Firetower Road bridge in East Montgomery County off FM 1485.  Deputies responded to that location and discovered the truck had been driven deep into the woods and set on fire. As they were investigating the truck they stumbled on Pourner’s body.  Information collected by investigators quickly led them to Brown who is from Conroe but has been living in Indiana. Brown had been in Montgomery County for a court hearing on a pending case. He then fled back to Indiana. Montgomery County Sheriff’s Department detectives went to Tippecanoe County, Indiana to speak with Brown once he had been arrested there without incident. After an extradition hearing he was transported back to Montgomery County where he was booked into the Montgomery County Jail on a $1 million bond. In February 2016 Brown was indicted on Capital Murder. However, after the indictment additional details have emerged.  On November 11, 2015, Pourner and Brown became involved in a heated argument at Daniel Kirksey’s home on Old Houston Road just north of SH 242. Kirksey was Pourner’s boyfriend.  It was there that Brown punched Pourner several times and then bound and gagged Pourner.  Brown then took Pourner, in Pourner’s truck to Caney Creek on Fire Tower Road just off FM 1485. As Kirksey watched, Brown hit Pourner again then strangled him to death telling Kirksey he felt his last heartbeat.  Kirksey then witnessed Brown light an object and throw it into Pourner’s truck, igniting it. The truck was so deep into the woods that the fire was never noticed and after the fire consumed it, it burned itself out.On September 1, 2016 a Montgomery County Judge released Brown on a $100,000 bond through A-1 Bail Bonds.  It had been 8-years since a a Capital Murder suspect was released on bond. On May 8, 2008 the late Judge Edwards released Glenn Holmes on a $50,000 bond. He fled and has yet to have been captured. Brown, however is set for trial in December. Kirksey was indicted last week on aggravated kidnapping charges and tampering with evidence. According to Montgomery County Assistant District Attorney Vince Santini Kirksey has not been charged with Capital Murder. Santini along with Assistant District Attorney Sherry Culberson will be prosecuting the Brown case in December. A date for Kirksey has not been set. The State is asking for life without parole for Brown.
