SMOKEY GETS 36 YEARS

leewilliam_thumbWilliam "Smokey" Lee was sentenced by the jury to life in prison in 2010 for violating the sex offender registration requirements. The case was reversed by the Court of Appeals because of an error in the jury charge, and the case was retried by prosecutors Mary Nan Huffman and Jason Larman.

Smokey Lee was released to Montgomery County on Parole in 2010 from a 99 year sentence out of Dallas County for Indecency with a Child enhanced with a prior rape conviction. Once he was released the law required him to register as a sex offender within seven days. Once registration is completed his sex offender status would have been on the internet as public record. Evidence showed that although he was reporting to his parole officer he avoided registering with the Montgomery County Sex Offender Compliance Unit. Mrs. Huffman told the jury that, "he was avoiding registration because he did not want his information on the DPS website. Lee wanted to live in our county anonymously, but don’t you know that’s what makes him even more dangerous. He was trying to be invisible."

After hearing Compliance Officer, Michelle Wallace, testify about Lee’s missed appointments, the jury found him guilty. This time, Lee elected to have visiting Judge P.K. Reiter assess his punishment. He was sentenced to 36 years.
