Teens Busted in Stolen Car, with Illegal Drugs

From the Liberty County Sheriff’s Office:

t appears that the alertness of a Liberty County Sheriff’s Deputy coupled with the apparent nervousness and drug induced actions of the driver of a stolen car resulted in the arrest of one adult and a juvenile for auto theft along with other charges. In addition, the actions of the driver who was known to be in possession of a stolen .45 caliber semi-automatic pistol made this arrest a very “high risk” encounter for this one-man patrol unit Deputy, but relying on his training and a cool head, the arrest was accomplished without a tragic incident occurring on either side.  

At 1:45am this morning, Deputy John Bennett was on routine patrol in the Hardin, Texas area and north bound on Hwy. 146 when he noticed a blue Chevrolet car also traveling north in front of his patrol unit, suddenly turn his head lights off and turn onto CR 2092. Deputy Bennett pulled closer behind the vehicle to obtain the license plate number when the car suddenly turned into a private drive way across the street from the Hardin Elementary School.  As the Deputy activated his emergency lights he called the license plate number into the dispatcher which is normal protocol for a traffic stop.

As Dep. Bennett was approaching the vehicle he observed two males in the front seat begin to move around erratically inside. Just as Dep. Burnett made it to the rear fender of the vehicle on the driver’s side, he was advised by Liberty Police Department Cpl. Frank Longoria, who was scanning the radio channels on his radio, that his agency was, at that very moment, taking a stolen vehicle report in the City of Liberty on that vehicle with that same license plate number. Cpl. Longoria further advised Dep. Bennett there was a fully loaded .45 caliber semi-automatic pistol in the console of the stolen vehicle. Dep. Bennett then drew his service weapon and assumed a defensive position and ordered both men from the vehicle.

Dep. Bennett stated that he was able to observe the driver begin to reach around his waist area. The two men did not respond to the first order to exit the vehicle so Dep. Bennett again demanded they get out of the vehicle with their hands visible. It was only after several commands that the driver complied and got out of the vehicle. The driver who was later identified as Cody Bryan Scott Howell, age 18 was handcuffed and secured. Then Dep. Bennett ordered the passenger from the car who also finally complied. This person was later identified as a 15 year old juvenile. After both subjects were secured, Dep. Bennett searched the vehicle and found the loaded .45 pistol had been moved from the console and placed in the door pocket of the driver’s door.

The driver, Cody Howell, appeared to Dep. Bennett to be “high” and Howell readily admitted that he has been on Methamphetamine all day. A search of the juvenile resulted in the recovery of prescription narcotics, Amphetamine. Deputy Bennett said the juvenile was presently on probation as well.

The driver, Cody Bryan Scott Howell, age 18 and from the Daisetta area was filed on for “Unauthorized Use of a Motor Vehicle” and “Theft of a Firearm” and placed in the Liberty County jail where J.P. Judge Stephen Hebert set Howell’s bond at $10,000.

The 15 year old juvenile was also charged with “Unauthorized Use of a Motor Vehicle”, “Theft of a Firearm” and “Possession of a Controlled Substance”. The juvenile was then placed in the Hardin County Juvenile Detention Center.
