MONTGOMERY COUNTY ST. PATRICK’S DAY DWI TASK FORCE
MONTGOMERY COUNTY- The latest effort by county and state law enforcement, on Tuesday night / Wednesday morning, to curb holiday drinking and driving was successful overall. The tried and true program had a new twist and an unfortunate reminder of another old and persistent problem.
For over two years, the Montgomery County Sheriff’s Office has coordinated “No Refusal” and DWI STEP programs on major holidays, events or weekends when a large number of people were expected to be on the road. “No Refusal” means anyone suspected of driving while intoxicated who refuses a breathalyzer test will have their blood alcohol content tested shortly thereafter.
MCSO Patrol Capt. Kenneth Ariola said advance warnings of the programs through news media have been successful deterrents, as evidenced by a relatively uneventful and low traffic New Year’s Eve in Montgomery County.
District Attorney Brett Ligon, who took his oath of office on New Year’s Day, promised his administration would be more directly involved in law enforcement at the street level and take a tough stance against intoxicated driving.
The DA’s office joined forces with the MCSO in coordinating the St. Patrick’s Day effort, which involved state and local law enforcement agencies along Interstate 45. Ligon, former attorney for the Houston Police Officer’s Union, procured HPD’s assistance in the form of their “BATmobile,” or Blood Alcohol Testing mobile unit. It was the first time a vehicle was provided in Montgomery County for on-scene blood draws.
HPD Traffic Enforcement Capt. Carl Driskell, who was with the BATmobile in South Montgomery County Tuesday night, called it a “great van.”
“It’s got an Intoxilyzer instrument in there, an HPD computer- we can file criminal charges from here,” Driskell said. “It’s complete.”
“With two holding cells in the back of the van, literally, we can set it upon any location.”
Judge Keith Stewart, Montgomery County Court at Law 5, was also part of the program, expediting the process by providing a physical presence.
“Any person that’s pulled over under suspicion of driving while intoxicated and the officer is satisfied that there’s probable cause, they’ll bring the driver here to the BATmobile,” Stewart said. “An Assistant District Attorney will present me with an affidavit for a search warrant, and if I find there’s probable cause, I will sign that, which will entitle them to take the blood sample from the defendant in that case.”
Several samples were taken at the BATmobile.
The program ran smoothly until a traffic stop in South Montgomery County reminded everyone that while having intoxicated drivers on the streets is dangerous, removing them from the streets can also pose serious danger.
Wrecker driver Joe Kearns had one of several wreckers on the overpass at Woodlands Parkway, where they were asked to stop with their lights on in order to make an Oak Ridge North PD traffic stop at the bottom of the overpass more visible to other drivers.
“We were staging behind a traffic stop- they had a DWI,” Kearns said. “A drunk driver ran into the back of one of the wreckers that was sitting there.”
Kearns approached the driver of the striking vehicle, who Kearns said asked him “what just happened.”
“I told him he ran into one of the tow trucks and he asked me to clarify which one it was,” he said. “Then he got back into the vehicle and was trying to back it up and we had to tell him to leave the vehicle where it was.”
Kearns said he did not believe the driver was trying to flee the scene, but simply to “adjust things.”
The wrecker’s female driver was inside when the vehicle was rear-ended. She was transported by MCHD ground ambulance to Memorial Hermann Hospital in The Woodlands with non-life threatening injuries.
The driver of the striking vehicle was arrested and charged with driving while intoxicated.
Ariola said the Sheriff’s Office was pleased with the results of the latest “no refusal” effort and will continue stepped-up DWI enforcement throughout the Spring Break week, with an “extra push” on Saturday night.

SHENANDOAH POLICE NAB HOME DEPOT THIEF
ust one day after Houston Police broke up a major Home Depot theft ring Shenandoah busted a Hispanic male for theft at the IH-45 and Tamina store.
A little after noon Wednesday loss prevention employees from the Home Depot on IH-45 at Tamina contacted Shenandoah Police in reference to a shoplifter in the store. As Shenandoah arrived the suspect Rolando Avila, age 30 ran out of the store and with loss prevention and police behind him ran to the Buffalo Wild Wings across the street. There he stashed his coat and tried to hide in the dumpster.
Police were able to locate his car in the parking lot. The keys for the Chevrolet Cavalier were in Avila’s possession.
Having consented to search the vehicle they found almost $800 worth of saber saw blades and various other tools. When they opened the trunk they found almost three times that much from other Home Depot Stores in the Houston and Spring Valley area.
The suspect had also removed the front and rear license plates of the vehicle.
In addition to the tools, they found almost fifteen pounds of fajita meat on the floorboard and even more saw blades wrapped in tin foil.
He also had what appeared to be a shopping list and doctor and lawyer contacts for Workman’s comp.
He was placed in custody and transported to the Montgomery County jail.
Detectives say this is not his first round as the charges will most likely be enhanced with the prior convictions.
Shenandoah is also working with other law enforcement agencies to determine if the cases from other Home Depot thefts are related.
Since Loss Prevention employees have started working in the Shenandoah store and the police department across the freeway from the store very few shoplifters are getting away.
The suspect Rolando Avila, age 30, is currently being held in the Montgomery County Jail on the theft charge with his bond set at $23000.

MAN SENTENCED FOR InTOX MANSLAUGHTER
On March 17, 2011, DPS Trooper Oelsner was on routine patrol when a vehicle passed him going the opposite direction at 98 miles per hour. The trooper turned around on the vehicle and stopped it. The driver, Daniel Freund, had no excuse for the speed he was doing. Oelsner, who has seen to many fatal crashes in his career, spoke harshly to Freund. He told Freund that he was going to kill himself or somebody driving like he was. He told him he was a young inexperienced driver who would to end up losing his license (costing him almost $2000 a year) or his life if he did not change his habits.
On March 14, 2012 Caney Creek Fire Department was dispatched just after 2 a.m. to a reported major accident in the 12800 block of FM 1485. MCHD was first to arrive on the scene and found a 2002 Saturn that had struck a utility pole. The vehicle snapped off not one but two utility poles that were paired next to each other. In addition, the top of the pole snapped, leaving 35,000 volts hanging overhead. Fire crews called for additional help from River Plantation Fire Department, Using three sets of tools it was a joint effort between firefighters, MCHD medics, deputies with the Montgomery County Sheriff’s Office and wrecker drivers to free the two teens from the twisted metal mass. After almost an hour, with the high voltage lines hanging just over their heads they were able to free the two and start medical care.
The male driver is Daniel Freund, 18-years-old. He was transported to Ben Taub Hospital in Houston in critical condition.
The female passenger has been identified as a 16-year-old Halie Mcdonald a Caney Creek High School student. She was transported to Hermann Hospital in Houston in critical condition with a severe head injury, internal injuries, and broken bones. She was pronounced dead a short time later.
Due to fog, the Air Medical Services were unavailable at the time.
Troopers investigated the crash as Entergy workers stood by to start making repairs and to restore service. DPS Trooper Oelsner who stopped Freund the year before was one of the Troopers investigating the crash. Early investigation shows the vehicle was southbound at a high rate of speed when it entered a curve. Running off the edge of the road, the vehicle slid sideways into the pole.
The posted speed limit in the area is 50 m.p.h.
On May 11, 2012, Daniel Freund was arrested and charged with intoxication manslaughter.
Monday morning Daniel Freund appeared in court. It was the morning that jury selection was to start for his trial this week. However, a call from Freund’s attorney to the District Attorney on Sunday with an offer that Freund would accept a 5-year sentence. A finding of a deadly weapon (the vehicle ) was added to it. With a deadly weapon having been found, Freund will spend at least 30 months incarcerated before even being eligible for parole.
Donna Kinser, Halie McDonald’s grandmother recalls the morning of the crash. They were preparing to go to the hospital as a family member was having surgery. She missed a call from the hospital and when she called back could not understand why t was Hermann in Houston. She was then told Halie had been brought there after a crash. She raced to Hermann and was told by a doctor coming out of Hailey’s room that she had just passed. He explained that her head injury was just so bad that they were unable to do anything with it.
She recalls waiting, wondering if anything would ever become of Freund. They were prepared to start attending the trial today when the phone call came last night that Freund was going to plea to five years in the Texas Department of Criminal Justice.
She said she was not really happy with the sentence as the man who pulled the donkey was sentenced to about the same. But then also she understood a jury could have possibly given him probation.
Ever since the crash, not a word was spoken to the family from Freund, not even an “I’m sorry”.
She said as he was shackled and cuffed this morning she was satisfied that he was finally going to prison to be held accountable for his actions.
She still has unanswered questions as to why Hailey was in Freund’s vehicle without her shoes, socks or cell phone. Any other time if Hailey thought a driver may be impaired or was not comfortable she would call her grandmother to pick her up.
Another friend, Morgan, who attended the party that night a boy’s house whose parents were out of town. She said alcohol was supplied but only remembers one-shot, Hailey only had one shot also. After that Morgan said she did not know what happened as she passed out. She awoke at 630am, unsure where she was and hearing of the crash with Hailey.
Freund will be eligible for parole in thirty months, he has 5 days’ credit currently. However, being eligible and making parole are two different things. Parole can actually put off the decision due to conduct in prison, friends and family fighting his parole or on their own account.

ESCAPE FROM MONTTGOMERY COUNTY JAIL
7 P.M. UPDATE- The search area of the perimeter has been lifted allowing employees of the Joe Corley Detention Unit , the Montgomery County Mental Health Unit and several bonding businesses to get get to their locations.
Today around 1:00 PM, a prisoner inside the Montgomery County Jail was determined to be missing and an immediate search was initiated of the exterior and surrounding areas of the jail.
A perimeter was set up and all traffic going in to the area of the Montgomery County Jail was shut down. Vehicles leaving were searched as other patrol units and dogs from the Montgomery County Sheriff’s Office, Conroe Police and DPS searched neighborhoods and heavily wooded areas surrounding the jail.
The prisoner, Britt Chadvurn Privatte, a white mail born 5-15-1972, was last seen in the recreation yard sometime earlier. Investigators believe that Privatte scaled a wall inside the recreation yard and broke through the upper fencing to the roof.
His black and white jail uniform was found on the roof of the jail. Once he left the roof area he was once again faced with having to scale at least one fence lined across the top with razor wire.
Privatte was arrested by the Houston Police Department on January 7, 2013, along with two other suspects involving a bank robbery inside the City of Houston but within the boundaries of Montgomery County in the Kingwood area.
Privatte was being held in the Montgomery County Jail on the following charges:
Aggravated Robbery Houston Police Department No Bond
Escape While arrested Houston Police Department No Bond
Burglary of a Habitation Harris County $20,000 Bond
Order of Arrest (Misdemeanor) Walker County $2,000 Bond
Aggravated Robbery X 3 Fort Bend County $50,000 Bond x 3
Privatte was known to work in the Walker County area and listed an address in Sugar Land, Texas as his home.
Investigators with the Montgomery County Sheriff’s Office, Texas Rangers and other local law enforcement agencies are working together using all available resources to track down and arrest the prisoner.
Privatte should be considered dangerous and anyone who may know the whereabouts of the escaped prisoner or has information they believe could be useful should call 936-760-5800 (Option 3) 24 hours a day or should contact their local law enforcement immediate.
This is the first escape in just over twenty-years from the Montgomery County Jail. The last two, back in the 90’s were both murder suspects and both captured within 10-days of their escape.
In one of those cases a Magnolia area attorney was murdered, not long after the suspect was arrested he escaped.

INTRUDER SHOT
About 9:30 pm a 64-year-old Porter Heights woman heard something at her front door. When she looked out she saw a male on the front porch within a gated entry area. She yelled out through the door for him to leave and stated that she was armed. At that point, the 27-year-old male attempted to gain entry to the home. Using a small-caliber revolver the homeowner shot twice through the door, When she looked out she no longer saw the male or a vehicle.
It was at that point she called the Montgomery County Sheriff’s Office.. Arriving officers found the male in front of the home.
MCHD transported the yet unidentified male to Ben Taub Hospital in Houston in very critical condition. He was pronounced dead on arrival.
The Montgomery County District Attorney’s Office responded along with Montgomery County Detectives.
No charges will be filed at this time but the case will be presented to the Montgomery County Grand Jury.

CLEVELAND BUS CRASH-19 STUDENTS INJURED IN BUS CRASH
About 2pm a Cleveland ISD bus with 57 s ROTC students on board was involved in a crash with an 18-wheeler on US 59 northbound just north of Greens Road. At this time only one right lane of the freeway is open and traffic is very heavy. Houston EMS transported 19 students and 1 adult to local hospitals with minor injuries. Most were bloody noses. Some parents arrived picking students up , a Cleveland ISD bus also respond to pick the remaining students up.
Houston Police are investigating but initial reports say a vehicle stopped in front of an 18-wheeler. That 18-wheeler stopped suddenly. With no place to go the bus slammed into the back of the 18-wheeler. The impact was so hard that it knocked the body of the International bus off the frame.
Students were taken to Northeast, Kingwood and LDJ Hospitals.

FATAL CRASH BOUDREAUX ROAD
On Tuesday, March 17, 2015, at approximately 8:30PM a male was driving a 2005 Ford pickup eastbound on Boudreaux Rd. At approximately the same time, a 2008 Dodge Charger was exiting a private driveway on the south side of the roadway. The Dodge backed out the driveway, stopping momentarily to begin moving forward when it was struck by the Ford. The Dodge came to rest in the ditch on the north side of the roadway. The Ford continued traveling eastbound, entered the ditch on the south side of the roadway and rolled over, striking a fence and coming to rest in the ditch along the south side of the roadway. The male driver was ejected from the Ford during the crash and was found with no signs of life on the scene at approximately 8:50pm A box truck which was westbound at the time saw the crash coming toward him. Taking evasive action the driver went into the ditch. He was not injured. The female driver told deputies she saw the vehicle coming quite a distance down the road and thought she had enough time to back out. However, deputies say do to the excessive speed of the Ford that timing was misjudged. No charges will be filed in the case at this time. The crash is currently being investigated by the Traffic Enforcement Division of the Harris County Sheriff’s Office.

bellshire 2 alarm fire
The City of Conroe Fire Department was notified of an apartment fire at 800 Bellshire Dr. (Bellshire Apartments) at 7:28 p.m. Tuesday.
Conroe firefighters arrived on the scene at approximately 7:30 pm and reported heavy fire showing from a 2-story apartment building. The fire was immediately attacked from the outside of the building in an attempt to contain the fire to the original building. A second alarm was called to assist with manpower.
In all, 8 engines and 2 ladder trucks were utilized to bring the fire under control. All occupants were accounted for, with a total of eight families being displaced. The Red Cross was called to assist with finding shelter for these families. It is unknown at this time whether any had renters insurance. The fire was contained to the original building and declared under control at approximately 8:20 pm.
The Conroe Fire Department was assisted by the Needham Fire Department, The Woodlands Fire Department, North Montgomery County Fire Department, and Montgomery County Hospital District EMS.
Four adult occupants were transported by Montgomery County Hospital District EMS to Conroe Regional Hospital with what appeared to be minor injuries. Their status is not known at the time of this release.
The Conroe Fire Department Fire Marshal’s Office has initiated an investigation into the origin and cause of the fire. The investigation is ongoing. It is believed that the fire originated on a stovetop and was unintentional in nature. The building was not equipped with a fire sprinkler system as it was built prior to the currently adopted fire code which requires fire sprinklers in all new apartment buildings.
The Conroe Fire Department would like to remind the general public of the dangers of leaving an operating stove or cooktop unattended. Unattended cooking is consistently the leading cause of unintentional fires both within Conroe and nationwide.

DIVERS SEARCH FOR VICTIM IN VEHICLE IN LAKE
Just after 11 pm, Tuesday Montgomery County Sheriff’s Office was dispatched to a major accident on LaSalle Dr, at the boat ramp. When they arrived they found a vehicle floating in the water. Within minutes the deputy called dispatch and stated it was sinking quickly. Montgomery County Precinct 1 Constable Lake Patrol Unit with their divers responded to the scene as did North Montgomery County Fire Department with a boat in tow. A firefighter hooks a cable to the vehicle from a wrecker and it was winched out. No victims were found in the vehicle. Divers continued to work the area of the small private lake in the Westlake Subdivision but never located a victim. The vehicle was registered in April Sound and deputies were attempting to make contact with the owners to establish a status on the vehicle.

HARRIS COUNTY PRECINCT 4 BUST
Early Tuesday morning Harris County Precinct 4 deputies were on routine patrol after a rash on motor vehicle break-ins. The deputies spotted a vehicle parked and observed two males walking. Those two males were carrying items that they had just stolen from additional vehicles. The two jumped in their vehicle and fled. with deputies in pursuit. Due to safety issues and the high speed of the pursuit, the chase was terminated just outside Tomball.
A short time later one of the deputies spotted the vehicle at the Whataburger in Tomball. As additional backup arrived they surrounded the suspects, taking them into custody. During a search of the vehicle deputies found both males to be armed with handguns. In addition long rifles, a GPS, a printer and several cell phones. A purse found was determined to have been stolen the night before in Glenloch Farms.
Precinct 4 is currently in the process of connecting those items with their owners.
Precinct 4 Deputy Chief Herman urges residents to keep your vehicles locked and valuables out of sight. “Out of sight out of mind”, Herman said. He also stated these thieves are thieving because they are lazy and they are going to take the easy route.

NURSE HIT BY VEHICLE
A nurse involved in an accident in front of a hospital in North Harris County has died, according to a Harris County Sergeant who worked the scene.
Life Flight was dispatched to the scene but did not load the patent.
The woman died at Northwest Medical Center Tuesday evening.
She was struck by a vehicle Tuesday afternoon in front of the center on FM 1960 near I-45. The victim apparently worked at the center.
Authorities say the driver initially fled the scene but shortly returned after hitting the victim…

December 31 is D-Day for the Grangerland Post Office.
The woman who has owned and operated the place for years has to take care of sick relatives and can’t work there anymore.
The U.S. Postal Service is taking the opportunity to cut bait with this small-town office.
Resident Irene Pawlowski, said, “That’s a real disappointment because since we’ve been here, we’ve really enjoyed the luxury of coming out here instead of having to go all the way out on the freeway.”
Don Granger — as in Grangerland — doesn’t want to see that happen.
The 89-year-old and his family built the post office back in the ’60s.
Granger said, “They say, ‘Well, we don’t need one, we don’t have the people,’ ‘Well, yes, we do. In a five-mile radius, some people estimate we have about 5,000 people.”
Granger would like to see the postal service find someone to replace the woman who works there now. But if they won’t do that, he’s got another idea. He’ll run it himself.
Granger said, “I’m gonna see what I can do about it, to help it establish and keep it here in the community.”
Granger could apply for a contract with the postal service. He would buy his own boxes, and would not have to stick to standard U.S. Postal Service prices.
Granger said, “I’d hire somebody to put up the mail, maybe not do as much as they used to do.”
Granger is devoted to his community. Keeping this post office is a priority.
March 17- Don Granger raises the American flag which was sent from Congressman Kevin Brady. The flag which was flown over the U.S. Capitol will now be flown in front of the Grangerland Post Office. Thursday morning was the Grand Opening of the new Grangerland postal facility. When the Postal Service announced it was closing the facility Granger contacted Congressman Brady and Postal Officials and promised the community that it would not close. He then contacted a retired postal worker, Jackie Mansito about helping continue the operation. Between the two of them, Grangerland Ship and Mail were created. Mansito leased the building from Granger and did a complete remodel with new key type boxes, replacing the old worn out combination boxes. Currently, they are working with the Postal Service to be a contract station. They now handle inbound and outbound mail and will also be shipping UPS, Federal Express and DHL. It remains at the same location it has since 1968 at FM 2090 and FM 3083.

SEX ASSAULT CHILd
The Montgomery County Precinct 3 Constable’s Office has arrested and charged defendant Teal, Claude Allen Ill on 3 counts of Aggravated Sexual Assault of a Child and 2 counts of Indecency with a Child. It is believed that the defendant sexually assaulted a juvenile female on multiple occasions. The defendant has been known to stay with multiple families in Montgomery County. When arrested the defendant was staying in a home that also functions as a daycare. In the 16900 block of Valiant Oak in the Montgomery Creek Ranch Subdivision. The offense occurred in The Woodlands and not at the
According to neighbors the owner of the home runs what appears to be a daycare from the home. Theresa Morris said that every afternoon around 3pm all you hear is doors banging and kids yelling. Most are elementary school age but there are some infants.
Teal apparently was renting a room from the owner of the home.
Children’s Safe Harbor assisted in the investigation.

WALKER COUNTY AMBER ALERT
The Walker County Sheriffs Office held a press conference Thursday afternoon to update the continuing investigation into the death of Caesar Vladimir Coronado and the Amber alert being issued for his 14-year-old daughter Adriana Coronado. The agencies who have been assisting with this investigation for the past 4 days- The Walker County District Attorney’s Office, The National Center for Missing and Exploited Children, The FBI’s Child Abduction Rapid Deployment Team and the Houston Police Department. As of 8 am this morning, Texas Equusearch has also joined forces in the investigation and is currently conducting a search of an undisclosed location in the Houston area.
Coronado picked his daughter up in Katy early last Saturday morning. On Sunday close to noon the Walker County Sheriff’s Office discovered the body of Caesar Vladimir Coronado on FM 2989 between Interstate 45 and Highway 75 in northernWalker County. This area is just south of the Madison County line.
On Sunday night Conroe Fire Department responded to a vehicle fire on Short Lane near Enterprise in a commercial area of Conroe. That vehicle was parked between the rear wall of a strip center and a wooded area. The 2011 Ford had been set on fire. The fire also damaged the rear wall of the building. The video was obtained from several businesses in the area. Due to lighting conditions, the video was not very clear. However, Sheriff McRae wants viewers to pay attention to the build of the man, the way he walks, etc. He can be seen by two different cameras. First, you can see the truck driving down Short Lane from Enterprise. Moments later you can see the flash from the flames. Then a heavy set male runs down Short Lane to an alley behind several commercial buildings on Enterprise to the U-Haul Dealership. It is there they believe the male got into a dark-colored SUV.

I-45 OFFICER INVOLVED SHOOTING
Police say they were following a group of robbers for an entire day before a deadly shootout.
Two people were killed Thursday night after several officers got into a gunfight with a group of attempted robbers in north Houston, police said. One of the suspects was even wearing an ankle monitor.
The shooting happened at a strip center in the 11300 block of the North Freeway, where police say five suspects were robbing the Affordable Furniture store. When they walked out, five officers were waiting on them. They exchanged fire.
Two of the suspects died at the scene, and a third was taken to a local hospital in an undisclosed condition. No officers were injured, and the remaining two suspects were taken into custody.
Houston Police have released the names of five officers involved in the shooting, and their years on the force. They are:
K. Huey – 20 years
J. Williams – 10 years
B. LeBlanc – 7 years
J. Calhoun – 9 years
R. Caldera – 3 years
Officers say they had been tailing the group of five men, who allegedly had been going business to business. All five men are believed to be part of the Blood gang from the northeast side of Houston. Police also believe the suspects had been involved in several robberies.
Charles White tells Eyewitness News his son was one of the two men killed. He contests his son was not involved in gang activity.
“I know he wasn’t in no gang. He might’ve been doing wrong but he wasn’t in no game,” White said.
The names of the suspected robbers have not been released.
Velicitas Torres says she was eating at with her family at the nearby Denny’s when they heard the gunshots and saw a bullet come through the window. Her son threw her to the floor to protect her from the gunfire.
The door to a nearby Sherwin Williams Paints store also is shot up. People inside the store were visibly shaken.
A crowd gathered soon after the shooting to see what happened. Alisa Conner was one of them.
“It’s just sad, scary, and crazy at the same time. They lost their lives trying to take from someone else,” Conner said.
Two of the suspects died. One has been identified as Scott Bennett. Two others are in jail. They are Lontay Young and Ross Anthony White-Leonard.
Both have long wrap sheets. Young, a documented gang member, has been in and out of jail for more than a decade. He’s convicted of several robberies, indecent exposure and trespassing.
White-Leonard also has a criminal history including drug charges and theft. The other suspect, Barry Jones, is in the hospital and will be charged once he’s released.

DIVERS RECOVER CAR FROM LAKE CONROE
Several teens were enjoying the day on Lake Conroe with their jet Ski. As they finished one of them backed the car to the boat ramp on Aspen Drive in Walden. As she was being directed back she hit the gas the car went to far back, and with the jet ski trailer on it began to float losing traction. The car floated back almost fifty feet before sinking. Montgomery Fire Department, Montgomery County Precinct 1 Constable Office Lake Patrol and TowBoats USA responded to the scene. A diver hooked the car to a wrecker which then pulled the vehicle out. There were no injuries.

MOCO EMERGENCY COMMISSIONERS MEETING FOOD ESTABLISHMENTS
The Office of County Judge Mark Keough along with the Office of Homeland Security and Emergency Management announces the following notice in lieu of recent events in Montgomery County. At 9:30 a.m. this morning Judge Mark Keough signed an order affecting food and drink establishments and movie theaters in response to the current and anticipated needs to respond to the COVID-19 crisis. The order is attached, and the content is below:
ORDER AFFECTING THE OCCUPANCY OF CERTAIN FOOD AND DRINK ESTABLISHMENTS
WHEREAS, a local disaster declaration was declared on March 12, 2020, ratified and extended for 30 days by a duly called Emergency Meeting of Commissioners Court.
WHEREAS, the COVID-19 virus is contagious and spreads through person-to-person contact, especially in group settings; and
WHEREAS, the U.S. Centers for Disease Control and Prevention (CDC) issued guidance to all Americans, requesting gatherings of 50 persons or more to cease for the next eight weeks on March 15, 2020; and
WHEREAS, President Donald J. Trump issued guidance that all Americans should limit gatherings to 10 or less; and
WHEREAS, an emerging public health emergency does currently exist and is expected to worsen, where Montgomery County desires to slow down and prevent the spread of COVID-19 throughout Montgomery County; and
WHEREAS, our contiguous neighbor, Harris County, issued an order on March 16, 2020 closing all restaurants and dining establishments, limiting them to only takeout, to-go, or drive-thru service options, and closing all bars and clubs throughout all of Harris County; and
WHEREAS, restaurants in their own right are a means to provide citizens of Montgomery County a means to access an alternative food source.
NOW, THEREFORE, I, COUNTY JUDGE OF MONTGOMERY COUNTY, TEXAS, PURSUANT TO THE AUTHORITY VESTED BY TEXAS GOVERNMENT CODE CHAPTER 418, HEREBY AMEND AND ORDER:
1) All restaurants shall reduce the occupancy of the entire premise to 50 people or less at any one time in total.
a. Tables shall be spaced a minimum of 10 feet apart.
2) All restaurants may continue to-go, takeout, delivery, and catering operations.
3) Restaurants shall not allow any employee to report to work who is sick.
a. Strict handwashing and sanitizing operations must be deployed.
4) Any bar or club shall limit occupancy to 50 persons or less at any one time in total.
5) Movie theaters shall limit occupancy to 25 persons or less per screen at any one time.
Lack of compliance could result in shut down and this order could be amended or extended at any time.
This order supersedes any provisions of a previous order issued March 16, 2020, that addresses restaurants
This order takes effect on March 17, 2020, at 3 p.m. and remains in effect until April 1, 2020, or until rescinded or extended by a future order.
This order does not alter or amend any previous order related to the occupancy of premises issued by the County Judge of Montgomery County, Texas, issued on March 16, 2020.

CONROE MOTORCYCLE FATAL FM 3083
Just before 5 pm, a 19-year-old teen was traveling west on FM 3083 at a high rate of speed on a Suzuki motorcycle. Witnesses say he was going in and out of lanes and passing on the shoulder. As he approached Pollock Road he again went to the shoulder passing traffic. A Waste Management roll-off trash truck which was also westbound was turning onto Pollock. The motorcycle slammed into the side of it after skidding for some distance. The motorcycle driver who was not wearing a helmet was pronounced deceased on the scene. Conroe Police investigated the crash.
