On Monday, September 27, 2021, at or about 2:40 AM, Andrew Wise Jr, and Diana Pena was leaving from Exit 73 bar & grill. Andrew Wise was operating a 2021 Chevrolet Silverado and Diana Pena was sitting in the front passenger side. They were was traveling southbound through the 23200 block of the North Fwy service road. Diana Pena and Andrew Wise were arguing over relationship issues inside the vehicle. Mr. Wise stopped the vehicle at the “T” intersection of Crossington Way and the North Fwy service road (southbound). Ms. Peña exited the vehicle and ran across the southbound service road towards the main lanes of the North Fwy (southbound). Ms. Peña ran on the main lanes far lane, a moving lane of traffic. Ms. Pena failed to yield the right of way to a motor vehicle and was struck by a 2018 Chevrolet Malibu vehicle operated by Joan Gutierrez. Seconds after the collision a 2017 brown Honda Odessey operated by Pauleen Currey struck Ms. Peña. Mr. Gutierrez was leaving from work and was traveling southbound in the outside lane. Mr. Gutierrez stated he did not see Ms. Pena in the roadway resulting in this collision. Ms. Currey was also traveling southbound in the outside lane and did see Ms. Peña lying on the roadway. Ms. Pena died on the scene from injuries sustained in this collision. Mr. Gutierrez and Ms. Currey showed no signs of intoxication. This case remains under investigation by the Harris County Sheriff’s Office, Vehicular Crimes Division.
