wrong way driver files for new trial

BAUKUS,NICOLENADRANichole Baukus, the woman responsible for driving the wrong way on Interstate 45 and killing two people after downing at least 23 alcoholic beverages may soon be in court again.

Baukus has filed a motion for a new trial. She has retained a new attorney and claims her previous attorney, Michael McDougal convinced her to plead guilty to intoxication manslaughter four days into her trial.

She now claims she didn’t’ understand what could happen by her pleading guilty. She claims cruel and unusual punishment.

Montgomery County Assistant District Attorney Warren Diepraam put on evidence showing her driving down the wrong side of the freeway. They showed video obtained from the club where she had at least 23 drinks before staggering out to the parking lot.

If found guilty by the jury she could have gotten 50 years. The Judge gave her 38 years after stacking the sentence the jury returned.

Fred Saunders ‘ son was one of the two killed in the crash and he to is outraged for her not taking responsibility for her actions.

The last trial will cost Montgomery County plenty. on August 6, 2013 her defense attorney Mike McDougal filed a request for payment to the court for representing her,  His bill presented requested over $17,000
