Cops Say He Tried to Shoot Sister, Boyfriend

LIBERTY COUNTY, TX / MONTGOMERY COUNTY, TX- On February 27, just before 5 a.m., Cleveland Police Officers Fleming and Neal responded to the Pinewood Trails Subdivision to the 22000 block of Black Spruce Dr. in Montgomery County in reference to a shooting.

Officers were met by a man and woman who said the woman’s brother, 21-year-old Alexis Mendez Garcia, of Houston, had fired a gun at them as they fled through the front door. The man and woman said they ran down the street and hid from the gunman.

The woman told Officers they’d find a bullet hole in the front door at her mom’s home. She said the argument began in the kitchen, and Garcia (her brother) was upset about the man supposedly keeping her away from her family.  The woman said she had already moved out of her family home, and only returned that night to visit with her mom.   Garcia, she said, began to argue with her boyfriend, and then pulled out a handgun and pointed it at him. She said her panicked boyfriend turned to run from Garcia, and she got between the two men.  The woman and her boyfriend, she said, ran out of the front door. Garcia allegedly fired the gun at them but missed, striking the door instead.  Officers checked the front door of her mom’s home, and found the bullet hole in the front door, just as she said they would. Officers went back to the home and spoke with the woman’s mother, who said she was asleep when the altercation happened and wasn’t a witness to any of it. Garcia was very uncooperative with officers.

Officers contacted CPD’s Criminal Investigations Division Detective Cooke and the Montgomery County District Attorney’s Office. Officers found a 9mm handgun believed to be the weapon used in the case.  Garcia allegedly chased his sister and her boyfriend outside after shooting at them.   They also claim Garcia ran over to the boyfriend’s vehicle and damaged the windshield.  Officers documented seeing major damage to the windshield. The victims said they managed to safely hide behind neighbor’s vehicles that were parked, as they called 911, and waited for police to arrive.  Garcia was uncooperative when confronted by police, and was arrested.

Garcia is charged with second-degree felony Aggravated Assault with a Deadly Weapon, and class B misdemeanor Criminal Mischief.

Officers later learned Garcia had an active Protective Order in the City of Houston, which he violated by possessing a firearm. Additional charges are pending.
