MAN ARRESTED FOR TUESDAY MORNING SHOOTING WAS RELEASED ON PAROLE IN APRIL

On Tuesday, November 2, 2021, at about 1:10 AM, Deputies with the Montgomery County Sheriff’s Office were dispatched to a report of a male with a gunshot wound at the Whataburger restaurant located at 6203 FM 1488 in Magnolia, Texas. During the investigation, it was learned the male was shot at the CubeSmart storage facility located at 29101 FM 2978 in Magnolia, and the alleged shooter was possibly still at the location. Deputies went to the storage facility and located the suspect,  who had the gun in his waistband, Brooks immediately became combative with Deputies. Several deputies, after deploying tasers were able to detain the suspect, who was identified as 26-year-old August Rain Brooks.
Detectives with the Montgomery County Sheriff’s Office Homicide and Violent Crimes Unit responded. As a result of the investigation, the suspect was transported to the Montgomery County Jail, where he was charged with Assault on a Public Servant and Aggravated Assault with a Deadly Weapon. He is currently in the Montgomery County Jail on a total of $150,000 in bonds.
The male who was shot was transported to a local hospital in stable condition.

Brooks is well known to Montgomery County Law Enforcement and the Court System. In 2013 he was arrested for delivery of dangerous drugs and given probation. Then in September of 2016, he was arrested in Montgomery County for assault/ family violence more than twice within a 12-month period. For that, he was given probation. Between the time he got probation and the time it was finally revoked was a period of 4-years. In August 2020 Judge Grant ordered his arrest again after testing positive for meth. In addition, there were twenty-four additional violations dating back to 2018. On December 20, 2020, he was sentenced to 5-years in the Texas Department of Criminal Justice. He was also given a total of  711 days which he had spent in jail on and off since 2016 on the same case. On April 12, 2021, not even 4-months after being sent to TDCJ he was paroled to Paris, Texas but was recently transferred to the Conroe Office.
