On September 24, 2021, the Montgomery County Sheriff’s Office responded to a reported sexual assault of a child call in Porter. The family of a 15-year-old girl alerted law enforcement after they learned that she had been having a sexual relationship with a 27-year-old male. Investigators learned that a relationship had begun when the girl was 13 years old but didn’t start sexually until she was 15. It continued multiple times until September of 2021 when he had taken her to a hotel. According to the report, the sexual relationship appeared to be consensual. However, the sexual assault of a child law is explicit. Under Texas Penal Code, Sec. 22.011(a)(2)(A), sexual assault with penetration of the anus or female sexual organ of a child is a second-degree felony. The offense involves a sexual assault against a child who is younger than seventeen (17) years of age. After several interviews at Children’s Safe Harbor, an arrest warrant was issued for Jonathan Mora Gutierrez, (08/01/91) of 503 W. Homan in Baytown. He was arrested on April 1, 2022, after turning himself in at the Montgomery County Sheriff’s Office. He was given a $30,000 bond and bonded out by A-1 Bail Bonds. He was then indicted by the Montgomery County Grand Jury on October 20, 2022. Gutierrez’s trial began in the Judge Maginnis 435th District Court on Monday, September 25, 2023. On the third day of trial, his family appeared to testify on his behalf. When the Bailiff called for Gutierrez he was nowhere to be found. Montgomery County Deputies went to his Baytown home but were unable to locate Gutierrez. His truck and cell phone were both at his home. Since the Jury had heard the two days of testimony Judge Maginnis sent the case to them. The Jury returned a verdict of guilty on September 27, 2023, and sentenced Gutierrez to 18 years in the Texas Department of Criminal Justice. Gutierrez, who was born in California has never had any prior legal issues. However, he is now a wanted fugitive.
