Anthony Graves was released from a Texas prison on October 27 after Washington-Burleson County District Attorney Bill Parham filed a motion to dismiss all charges that had resulted in Graves being sent to death row 16 years ago. Graves was convicted in 1994 of assisting Robert Carter in multiple murders in 1992. There was no physical evidence linking Graves to the crime, and his conviction relied primarily on Carter’s testimony that Graves was his accomplice. Two weeks before Carter was scheduled to be executed in 2000, he provided a statement saying he lied about Graves’s involvement in the crime. He repeated that statement minutes before his execution. In 2006, the U.S. Court of Appeals for the Fifth Circuit overturned Graves’s conviction and ordered a new trial after finding that prosecutors elicited false statements and withheld testimony that could have influenced the jurors. After D.A. Parham began to reassemble the case and review the evidence, he hired former Harris County assistant district attorney Kelly Siegler as a special prosecutor. Siegler soon realized that making a case against Graves would be impossible: “After months of investigation and talking to every witness who’s ever been involved in this case, and people who’ve never been talked to before, after looking under every rock we could find, we found not one piece of credible evidence that links Anthony Graves to the commission of this capital murder. This is not a case where the evidence went south with time or witnesses passed away or we just couldn’t make the case anymore. He is an innocent man,” Siegler said.

SPLENDORA CITGO ROBBERY AND PURSUIT TO HOUSTON
At 9:27 p.m. on Friday, a white male wielding a shotgun robbed the Citgo store on US 59 in Splendora, displaying the weapon to the female cashier and a female customer and demanding all the money from the register. The cashier complied and when the bandit left, she and the customer called 9-1-1 and provided police with a description of his vehicle and his license plate.
At 9:27 p.m., Montgomery County dispatch aired a “robbery past” and an “attempt to locate” on the suspect vehicle to all Montgomery County law enforcement agencies. At 9:38 p.m., a Pct. 4 Deputy Constable spotted the suspect’s 1996 Ford Ranger pickup on US Hwy 59 southbound near Kingwood Drive and began to follow. The deputy activated his emergency equipment, but the truck did not stop. Eleven additional Pct. 4 units responded, including Constable Kenneth “Rowdy” Hayden Montgomery County Sheriff’s Office also assisted but seeing enough units were involved ceased the pursuit at the county line.
The pursuit continued southbound on US Hwy 59 through Humble and into Houston. The suspect then took Loop 610 North to Loop 610 West and then exited onto Hempstead Road westbound. Shortly thereafter, Pct. 4 deputies had an opportunity to safely use the PIT maneuver to stop the suspect. The pursuit lasted for about 20 minutes and a distance of around 40 miles.
The suspect was arrested without incident. Pct. 4 deputies transported him back to Montgomery County where they handed him over to Splendora Police who transported him the Montgomery County Jail in Conroe.
Zachary Lynn Mason, 30, of Needville is charged with Aggravated Robbery and Evading Arrest/Detention in a Vehicle. Additional felony charges may be filed in Harris County.
Constable Hayden said the pursuit was a particularly dangerous one.
“We were dealing with an armed suspect who was driving erratically, reaching speeds of over 125 miles per hour,” Hayden said. “Fortunately, it ended well – no one was injured, the suspect is in custody and the store owners have their money back.”
He also praised the store clerk and customer for their handling of the situation and their quick thinking in getting the vehicle’s license plate and a description for police.
“If it weren’t for the details they provided, the suspect would probably still be at large,” Constable Hayden said.
Pct. 4 later learned an “attempt to locate” had been aired on the same vehicle in Liberty County shortly before the robbery, after the suspect struck a vehicle in Cleveland and fled the scene.
Agencies assisting with the pursuit in Harris County included the Humble Police Department, Houston Police Department, Harris County Sheriff’s Office and the Texas Department of Public Safety.

BODY FOUND IN WOODLANDS
On today’s date, Monday, October 28, the Montgomery County Sheriff’s Office received a 911 call at 1:48 PM, in reference to a welfare concern on the property of the Stone Bridge Church. The Stone Bridge Church is located at #1 Stone Bridge Church Drive, in The Woodlands, Texas.
The caller advised he believed that a body was lying near a recreational area, on the church property. Montgomery County Sheriff’s Office units responded to the location and located a deceased subject. Detectives and Crime Scene Investigators from the Montgomery County Sheriff’s Office Major Crimes Unit were called to the scene. Detectives are still at the scene investigating.
The body of the deceased will be transported to the Montgomery County Forensics Center, in Conroe, for an autopsy.

SAND PIT THEFT SOLVED BY MIB IN 6 HOURS
Just after 6 am. Montgomery County Precinct 4 Constables Office was alerted by a security guard at a sand pit plant in Bennette Estates Subdivision of a theft. Information was relayed to them of the type of truck used. The security guard followed the suspect but lost him in the subdivision. With only one way in and out of the subdivision a deputy posted at the entrance of the subdivision.
The owner of the equipment reported that two Lincoln Welding machines, a $3000 equipment chain and several pipe racks had been stolen.
Precinct 4 deputies using patrol cars and 4-wheelers fanned out throughout the subdivision in a search for the equipment.
Just after noon on McGregor Drive in Bennette Estates the equipment was spotted. . As they approached the mobile home, Chanz Lee Brown, 21, fled out the back door in his stocking feet and into the woods.
Precinct 4 deployed their Bloodhound, “Oliver” and within minutes the suspect was located in the woods and taken into custody.
The equipment was then returned to the owner.
Brown was taken into custody. Deputies believe another suspect may be involved.
The total value of the equipment is estimated at $18,000.

SPRING TEEN SHOOTING
Police say a dispute over a girl led to a confrontation and shooting Wednesday night at a South Montgomery County apartment complex.
Around 8 p.m., the Montgomery County Sheriff’s Office responded to multiple 911 calls regarding shots fired at the Park at Woodlands Springs Apartments in the 24000 block of Richards Road off of Rayford Road. MCSO Lt. Brady Fitzgerald said they arrived to find a male juvenile with a gunshot wound to the arm. MCHD medics transported the victim to an area hospital in stable condition.
Fitzgerald said the preliminary investigation indicated a group of teenage boys went to the victim’s apartment and began trying to entice him into going outside. The victim’s mother confronted the group, Fitzgerald said. The victim joined in, and as tempers flared, the altercation became physical and handguns were drawn by both sides. A series of shots were fired by the victim, suspect and the victims mother, The juvenile victim was struck by a bullet believed to have been fired by a 17-year-old who then fled the area. Almost twenty casings littered the courtyard area in front of the 1300 building. It was reported that as the shooter ran off he was firing back over his shoulder.
MCSO’s major crimes investigators and gang taskforce responded to investigate. Since the teens knew one another, investigators have the suspect identified, but he was not in custody as of this writing and they did not release his identity on the scene.

Around 8:30 pm Sunday Shenandoah Police was dispatched to the Twin Peaks Restaurant on I-45 in Shenandoah. Units arrived to find a Twin Peaks employee in the back parking lot performing CPR on a male. The male was transported in critical condition to Memorial Hermann Hospital in critical condition. As of midnight, he was still in surgery. All police are saying at this time is that it was an altercation between the two males and one was shot according to Shenandoah Assistant Police Chief Gresham. The white male suspect fled the scene in a black vehicle with an unknown license number. If anyone has information or saw the incident you are asked to call the Shenandoah Police Department.

JOINT OPERATION RESULTS IN ARREST OF 7 ATM THIEVES CAUGHT IN THE ACT
Houston Police overnight-tailed four different vehicles with eight suspects who were believed to be involved in ATM thefts. They followed them to the Kroger Store in the Valley Ranch Shopping Center. Under the fully lit parking lot and employees in the Kroger Store, the DPS helicopter overhead witnessed the suspects using a cutting torch to remove the secure bar on the ATM. Then as they started to break into the ATM HPD and Montgomery County Sheriff’s Units along with Montgomery County Precinct 4 Constables were radioed to move in. As they did the vehicles fled onto SH 99, One truck drove through a flower bed at the Kroger and sped off, one vehicle was stopped at the movie theatre, another at What A Burger and the other vehicle fled into Forest Colony where they got lost and crashed out, taking off on foot. The manhunt began. Two were found in a shed. Another was captured after he broke down a gate coming from a yard. In all seven of the eight were captured, two of them females. All were transported to the Montgomery County Jail.
